FERMI 2 - WITHDRAWAL OF AN AMENDMENT REQUEST (TAC NO. MB5174)

Dear Mr. OConnor:

By letter dated May 23, 2002, you applied for an amendment to the Fermi 2 Facility Operating License No. NPF-43. The proposed change would have modified the facility Technical Specifications by revising the requirements for system operability during movement of recently irradiated fuel assemblies in the secondary containment. Subsequently, you determined that you would not pursue this issue; and, in a telephone conversation on March 26, 2003, between Mr. Rodney Johnson of your staff and me, he explained that you planned to withdraw the amendment request.

Unless you notify us that we are incorrect by May 30, 2003, we will consider the application as withdrawn and will file a Notice of Withdrawal of Application for Amendment to Facility Operating License with the Office of the Federal Register for publication and close this action.
