In the referenced letters, Exelon Generation Company, LLC (Exelon) and AmerGen Energy Company, LLC (AmerGen) requested an exemption from the 1 OCFR50.36, "Technical Specifications," paragraph (c)(1) requirement for the inclusion of the Safety Limit Minimum Critical Power Ratio (SLMCPR) values in the Technical Specifications for all of our Boiling Water Reactors. Upon approval of the exemption request, separate license amendment requests would have been submitted to change each plant's Technical Specifications to eliminate the specific SLMCPR value, to state that the SLMCPR would be calculated in accordance with NRC-approved methodologies, and to specify that the SLMCPR limit would be maintained in the Core Operating Limits Report.

Withdrawal of SLMCPR Exemption Request April 29, 2003 Page 2 By letter dated April 4, 2003, the Nuclear Energy Institute (NEI) submitted Technical Specifications Task Force (TSTF) Traveler 357 (Revision 1) to NRC for review. This TSTF involves removal of the SLMCPR values from the Technical Specifications. The concept of this proposed TSTF was discussed with the NRC by the Boiling Water Reactor Owners' Group (BWROG) Executive Oversight Committee at a meeting held in February 2003. After further consideration and given the industry TSTF, Exelon and AmerGen have decided to withdraw the exemption request submitted via the referenced letters. Exelon and AmerGen request that the NRC fully consider the merits of TSTF 357, Revision 1. We believe that removal of the SLMCPR values from the Technical Specifications, while continuing to require that the values be calculated in accordance with NRC-approved methodologies, provides a sound approach to maximizing the use of NRC and licensee resources with no adverse impact on safe operation of the plants.
Exelon and AmerGen hereby withdraw the exemption request submitted in the referenced documents.
