ISSUANCE OF RENEWED FACILITY OPERATING LICENSE NOS. DPR-44 AND DPR-56 FOR PEACH BOTTOM ATOMIC POWER STATION, UNIT NOS.

Dear Mr. Gallagher:

The U.S. Nuclear Regulatory Commission (NRC) has issued Renewed Facility Operating License Nos. DPR-44 (Enclosure 1) and DPR-56 (Enclosure 2) together with the Technical Specifications, Appendix A (Enclosures 3 and 5), and the Environmental Technical Specifications, Appendix B (Enclosures 4 and 6), for the Peach Bottom Atomic Power Station, Unit Nos. 2 and 3 (Peach Bottom, Units 2 and 3). These renewed facility operating licenses have been issued on the basis of our review of your application dated July 2, 2001, as supplemented by letters dated November 26 and December 19, 2002; and January 14, January 29, January 31, and February 5, 2003. The Technical Specifications for Peach Bottom, Units 2 and 3, were not amended as a result of our review.

Renewed Facility Operating License No. DPR-44 (the renewed license for Peach Bottom, Unit 2) expires at midnight, August 8, 2033. Renewed Facility Operating License No. DPR-56 (the renewed license for Peach Bottom, Unit 3) expires at midnight, July 2, 2034.

The technical basis for issuing the renewed licenses is set forth in NUREG-1769, Safety Evaluation Report Related to the License Renewal of Peach Bottom Atomic Power Station, Units 2 and 3, dated March 2003. The results of the environmental review related to the issuance of the renewed licenses are contained in NUREG-1437, Generic Environmental Impact Statement for License Renewal of Nuclear Plants, Supplement 10, Regarding Peach Bottom Atomic Power Station, Units 2 and 3," dated January 22, 2003.

Amendment 250 to the Facility Operating License for Unit 3 was issued by the NRC on November 22, 2002. The Facility Operating License is now superseded by the Renewed Facility Operating License. Amendment 250 authorized an increase in power level. It is to be implemented following installation of an improved feedwater flow measurement system during the 14th refueling outage, currently scheduled for fall 2003. Amendment 250 includes a revised page number three for the Unit 3 Facility Operating License, and several revised pages for the Unit 3 Technical Specifications. Upon implementation of Amendment 250, do not replace

M. Gallagher page 3 of the Renewed Facility Operating License, since the Renewed Facility Operating License already reflects the increased power level. As the Technical Specifications changes approved by Amendment 250 have not yet been implemented, the Technical Specifications issued with the Renewed Facility Operating License for Unit 3 do not contain the revised pages identified in Amendment 250. is a copy of the related Federal Register notice of issuance of the renewed licenses. DPR-44, AND DPR-56 FOR AN ADDITIONAL 20-YEAR PERIOD Notice is hereby given that the U.S. Nuclear Regulatory Commission (the Commission) has issued Renewed Facility Operating License Nos. DPR-44, and DPR-56 to Exelon Generation Company, LLC (Exelon) and PSEG Nuclear, LLC (the licensees) of the Peach Bottom Atomic Power Station, Units 2 and 3 (Peach Bottom, Units 2 and 3). Exelon is the operator of Peach Bottom, Units 2 and 3. Renewed Facility Operating License No. DPR-44 authorizes operation of Peach Bottom, Unit 2, by Exelon at reactor core power levels not in excess of 3514 megawatts thermal in accordance with the provisions of the Peach Bottom, Unit 2, renewed license and the Technical Specifications. Renewed Facility Operating License No. DPR-56 authorizes operation of Peach Bottom, Unit 3, by Exelon at reactor core power levels not in excess of 3514 megawatts thermal in accordance with the provisions of the Peach Bottom, Unit 3, renewed license and the Technical Specifications.

Peach Bottom, Units 2 and 3, are boiling water nuclear reactors located partly in Peach Bottom Township, York County, partly in Drumore Township, Lancaster County, and partly in Fulton Township, Lancaster County in southeastern Pennsylvania.

The applications for the renewed licenses complied with the standards and requirements of the Atomic Energy Act of 1954, as amended (the Act), and the Commissions regulations. As required by the Act and the Commissions regulations in 10 CFR Chapter I, the Commission has made appropriate findings, which are set forth in each license. Prior public notice of the action involving the proposed issuance of these renewed licenses and of an opportunity for a hearing regarding the proposed issuance of these renewed licenses was published in the Federal Register on August 31, 2001 (66 FR 46036).
