Dear Mr. Chairman:
This letter forwards additional agency records responsive to your letter dated May 24, 2002, in which you requested records related to the reactor pressure vessel head degradation at the Davis-Besse Nuclear Power Station. The Nuclear Regulatory Commission (NRC) has previously provided two sets of records that were sent to your office with my letters dated June 14 and July 1, 2002. I expect that a final set of documents responsive to your request will be sent you by the end of next week.
The records that we are providing you in this and in our other responses have been identified as a result of a comprehensive and conscientious search for records by agency staff.
These records represent correspondence with the Davis-Besse licensee, communications with the nuclear industry, internal NRC notes, memoranda and e-mail, and non-documentary material (such as photographs) related to the agency's oversight of the Davis-Besse licensee and response to technical issues related to the facility's degraded reactor pressure vessel head.
As you will note from the enclosed list, some of the records are not currently available to the public because they constitute pre-decisional, intra-agency memoranda or, in a few instances, because they contain proprietary information. The unauthorized release of proprietary information in particular could result in sanctions under the Trade Secrets Act.
Non-public documents are marked as such, and I request that you restrict access to this information to Members and staff of the Committee. The NRC may determine to make some of these documents available to the public in response to a pending request under the Freedom of Information Act (FOIA). We will inform you if the status of any of these currently non-public documents changes as a result of the FOIA review.
Additionally, the NRC's Office of Investigations (01) is conducting an investigation of potential wrongdoing related to the licensee's handling of the reactor vessel head degradation matter. 01 has briefed Committee staff twice on the status of the investigation. The NRC's Inspector General is also examining issues related to the Davis-Besse matter.
