Duke Energy Corporation Oconee Nuclear Station, Units 1, 2, and 3 NRC Docket Nos. 50-269, 50-270, 50-287 McGuire Nuclear Station, Units 1 and 2 NRC Docket Nos. 50-369, 50-370 Catawba Nuclear Station, Units 1 and 2 NRC Docket Nos. 50-413, 50-414 RESPONSE TO NRC ORDER FOR COMPENSATORY MEASURES RELATED TO ACCESS AUTHORIZATION In accordance with 10 C.F.R. § 50.4, Duke Energy Corporation ("Duke") hereby submits its response to the Order For Compensatory Measures Related To Access Authorization

("Order") issued by the United States Nuclear Regulatory Commission ("NRC") on January 7, 2003, for 50-269, 50-270, 50-287, Oconee Nuclear Station, 50-369, 50-370, McGuire Nuclear Station, and 50-413, 50-414, Catawba Nuclear Station.

Duke will comply with the requirements described in Attachment 2 to the Order and shall complete implementation no later than July 7, 2003, with the exception of compensatory measure B.1.1, which shall be implemented no later than April 7, 2003, and C.1.6 and C.1.8, which shall be completed no later than January 7, 2004, at which time Duke will report full compliance to the Commission as required by the Order. In achieving compliance, Duke will rely on Enclosure 4 to the Order "Implementing Guidance," and any subsequent guidance promulgated or endorsed by the NRC.

The following is provided making specific reference to NRC, Regulatory Issue Summary 2002-13: "Confirmation of Employment Eligibility:"

Pursuant to the Order, Attachment 2, compensatory measure B.1.3(c), Duke will confirm eligibility for employment, within the time frames allowed and while observing other restrictions of the Immigration and Naturalization Service ("INS") or its successor, for new Duke employees who are expected to seek unescorted access. With specific reference to the requirements of the Order, Attachment 2, compensatory measure 03

U.S. Nuclear Regulatory Commission January 22, 2003 Page 2 B.1.3(c), 2ýd sentence, Duke will comply, noting however, that the Order recognizes such inquiries can only be completed to the "fullest extent possible," and that NRC, Regulatory Issue Summary 2002-13 notes the limitations facing licensees on this point as well. Duke contractors and vendors will be directed to verify employment eligibility as required by the INS or its successor.
