Dear Mr. Scarola:

By letter dated December 4, 2002, Carolina Power & Light Company (CP&L) requested the Nuclear Regulatory Commissions (NRCs) approval to use a more recent edition and addenda of the American Society of Mechanical Engineers (ASME) Code for Operation and Maintenance of Nuclear Power Plants (OM Code) for testing pressure relief devices in the Harris Nuclear Plant (HNP) inservice testing (IST) program. The current Code of record for the HNP IST program is the 1987 Edition and 1988 Addenda of the ASME OM Code. CP&L requested approval to use the portions of the 1998 Edition up to and including the 2000 Addenda of the ASME OM Code related to inservice testing of pressure relief devices for the remainder of its second 10-year IST interval. CP&L stated that it would apply all the related requirements in Mandatory Appendix I, Inservice Testing of Pressure Relief Devices in Light-Water Reactor Nuclear Power Plants, of the 1998 Edition up to and including the 2000 Addenda of the ASME OM Code. CP&L committed to full implementation of Mandatory Appendix I within 60 days of NRC approval.

Section 50.55a(f)(4)(iv) states that IST of pumps and valves may meet the requirements set forth in subsequent editions and addenda that are incorporated by reference in 10 CFR 50.55a(b), subject to NRC approval. Portions of editions or addenda may be used provided that all related requirements of the respective editions and addenda are met. The 1998 Edition up to and including the 2000 Addenda of the ASME OM Code were incorporated by reference in 10 CFR 50.55a(b) on September 26, 2002 (67 FR 60520), with no modifications or limitations placed on Mandatory Appendix I requirements. Therefore, the request to use the portions of a later Code and Addenda associated with the IST of pressure relief devices at HNP, submitted by CP&L in its letter dated December 4, 2002, is approved pursuant to 10 CFR 50.55a(f)(4)(iv) for the remainder of the second IST interval.
