SOUTH TEXAS PROJECT, UNITS 1 AND 2 - WITHDRAWAL OF AN AMENDMENT REQUEST (TAC NOS. MB4051 AND MB4052)

Dear Mr. Cottle:

By letter dated February 14, 2002, you applied for an amendment to the South Texas Project, Units 1 and 2, Facility Operating License Nos. NPF-76 and NPF-80, respectively. The proposed change would have modified the facility technical specifications (TS) pertaining to TS 3.4.2.2, Reactor Coolant System. to relax the lift setting tolerance of the pressurizer safety valves from +/-2 percent to +/-3 percent. Subsequently, by letter dated December 2, 2002, you withdrew the amendment request.

The Commission has filed the enclosed Notice of Withdrawal of Application for Amendment to Facility Operating License with the Office of the Federal Register for publication.

7590-01-P UNITED STATES NUCLEAR REGULATORY COMMISSION STP NUCLEAR OPERATING COMPANY DOCKET NOS. 50-498 and 50-499 NOTICE OF WITHDRAWAL OF APPLICATION FOR AMENDMENT TO FACILITY OPERATING LICENSE The U.S. Nuclear Regulatory Commission (the Commission) has granted the request of STP Nuclear Operating Company (the licensee) to withdraw its February 14, 2002, application for proposed amendment to Facility Operating License Nos. NPF-76 and NPF-80 for the South Texas Project, Units 1 and 2, respectively, located in Matagorda County, Texas. .

The proposed amendment would have revised the Technical Specifications (TSs) pertaining to TS 3.4.2.2, "Reactor Coolant System," to relax the lift setting tolerance of the pressurizer safety valves for +/-2 percent to +/-3 percent.

The Commission had previously issued a Notice of Consideration of Issuance of Amendment published in the FEDERAL REGISTER on April 2, 2002 (67 FR 15628). However, by letter dated December 2, 2002, the licensee withdrew the proposed change.

For further details with respect to this action, see the application for amendment dated February 14, 2002, and the licensee's letter dated December 2, 2002, which withdrew the application for license amendment.
