BROWNS FERRY NUCLEAR PLANT, UNITS 2 AND 3 - FUEL VENDOR CHANGE, EXTENDED POWER UPRATE, AND MAXIMUM EXTENDED LOAD LINE LIMIT ANALYSES PLUS SUBMITTALS (TAC NOS. MB7253 AND MB7254)

Dear Mr. Scalice:

By letter dated November 21, 2002, you notified the NRC staff of your plans for licensing and implementing the Fuel Vendor Change, Extended Power Uprate (EPU), and the Maximum Extended Load Line Limit Analyses Plus (MELLA+). Subsequently, on October 16, 2002, a meeting was held between TVA and Framatome (i.e., TVAs fuel vendor) and the NRC staff regarding TVAs planned transition to Framatome fuel.

Your letter discussed two options for EPU that appear to be viable based on your interaction with the staff. These are: (1) a process such as that proposed in the Constant Pressure Power Uprate License Topical Report, which is under staff review, and (2) the Extended Power Uprate License Topical Report Process. The letter described your understanding of the two EPU options and the implications associated with each one, and provided a preliminary schedule for your submittals regarding the Fuel Vendor Change, EPU, and MELLA+.

Based on our review of your letter, the staff agrees, in general, with your characterization of the two EPU options. Your requested timeframe of about 1-year for NRC review of the above submittals depends to a great extent on the quality of your submittals.
