Florida Power AProgress Energy Cwpany PNSC MEETING WAIVER Crystal River Unit 3 Meeting 2002-34 F iAiiust22;z,2002 NCR described below was reviewed and accepted by the PNSC Chairman in accordance with PNSC Procedure, AI-301, Rev. 3, Section 4.2.2., waiving a formal PNSC Membership review:

NCR 67742 - At approximately 08:52 a.m., Site Security recovered a dead sea turtle from the CR3 Intake Structure on August 1, 2002. The turtle was taken to the Mariculture Center where staff biologists identified it as an endangered species requiring a 4-hour report to the NRC. Staff biologists also determined the turtle had died due to causes unrelated to CREC operations. The CR3 control room was notified No safety significant issues were identified.

1. Event Description Site Security recovered a dead sea turtle from the CR3 intake structure.
2. Investigation Results (Consider the following)

WhLat happened and How the event/condition occurred; A sequence of events: At approximately 08:52 Site Security recovered a dead sea turtle from the CR3 intake structure. The turtle was taken to the mariculture center. Staff biologists evaluated the turtle at 09:12 and determined that it was an endangered species and that is had died due to causes unrelated to CREC operations.

CR3 control room was notified of this determination at 09:20.

Specific activities being performed; The recovery occurred during routine observation of the intake area.

Group involved /Experience level of personnel; Personnel performing the recovery are trained in turtle recovery.

Consequences of the event/condition; Recovery of sea turtles which meet the threshold for reporting to the NMFS also require NRC notification.

Any related equipment performance problems; NA The extent of condition of the problem. This turtle is the 7d' non-causal take since January 1, 2001.

3. Inappropriate Acts / Equipment Malfunctions There were no inappropriate actions or equipment malfunctions. Personnel performed their duties in accordance with AI-571. This NCR was written to document the turtle take as it was expected to require a 4 hour4.62963e-5 days <br />0.00111 hours <br />6.613757e-6 weeks <br />1.522e-6 months <br /> notification to the NRC. This NCR was classified as priority 1 in accordance with CAP-NGGC-0200. Turtle takes which meet the NMFS reporting threshold are reportable as 4 hour4.62963e-5 days <br />0.00111 hours <br />6.613757e-6 weeks <br />1.522e-6 months <br /> reports under 10 CFR 50.72 (B)(2) as this relates to protection of the environment for which notification to other government agencies has or will be made.

5. Does this event involve a loss of a Maintenance Rule function? [ Yes 0 No (If Yes, contact System Engineer. Contact Maintenance Rule Engineer for assistance if needed.)
6. Previous Operating Experience (Internal and External) Prior to this event, 6 sea turtles were determined to have died from causes unrelated to CREC operations. One turtle, recovered from CR1&2 intake was classified as a causal mortality.

7. Generic Implications Future sea turtle takes haven been acknowledged by the NRC and NMFS. The NMFS is reviewing a request to revise the biological opinion terms and conditions.
