NRC STAFFS RESPONSE TO INTERVENORS MOTION FOR AN EXTENSION OF TIME TO RESPOND TO DUKE ENERGY CORPORATIONS MOTION TO DISMISS CONTENTION 2 On December 23, 2002, Duke Energy Corporation (Duke) filed a motion to dismiss consolidated Contention 2. On December 31,2002, Intervenors, Blue Ridge Environmental Defense League (BREDL) and Nuclear Information and Resource Service (NIRS) (collectively, Intervenors) filed a motion for an extension of time to file a response to Dukes motion. The NRC staff (Staff) hereby files its response to the Intervenors motion for extension of time.

The Staff does not object to a reasonable extension of time to respond, so long as the Staff is given a corresponding extension of time.
