DAVIS-BESSE NUCLEAR POWER STATION - INSPECTION SCHEDULE UPDATE

Dear Mr. Myers:

The purpose of this letter is to provide you with an updated schedule of baseline inspections and special inspections at the Davis-Besse Nuclear Power Station so that you will have an opportunity to prepare for these inspections and to inform us of any planned inspections which may conflict with your plant activities.

On March 4, 2002, the U.S. Nuclear Regulatory Commission (NRC) issued our annual assessment of Davis-Besse performance during 2001. That letter included our plans for future NRC inspections at your facility through March 2003. On March 6, 2002, you discovered and reported to the NRC significant corrosion and wastage of the reactor pressure vessel (RPV) head. Subsequently, by our letter dated April 29, 2002, we informed you of our plans for focused and coordinated oversight of the Davis-Besse Nuclear Power Station under NRC Inspection Manual Chapter (IMC) 0350, Oversight of Operating Reactor Facilities in a Shutdown Condition with Performance Problems, as a result of performance problems that resulted in the RPV head degradation.

Consistent with IMC 0350, the NRC's Davis-Besse Oversight Panel determined the baseline inspection schedule for your facility using the Reactor Oversight Process, including the plant's performance indicators, as guidance. It is expected that you will continue to submit valid performance indicators during the current extended shutdown.

Throughout the past six months the NRC has conducted special inspections to review the effectiveness of your efforts to identify and correct the deficiencies that led to the reactor pressure vessel head degradation. The special inspections have confirmed progress in identifying and in beginning to resolve some of the issues contained in our Restart Checklist.

Work remains by your staff and the NRC staff to confirm that you have adequately resolved the Restart Checklist issues. The NRC will continue special inspection activities to assess the adequacy of actions related to the Restart Checklist.

 Organizational Effectiveness and Human Performance Inspection (Restart Checklist Items 1.b and 4.a through 4.c)

 Reactor Pressure Vessel Head Replacement Inspection (Restart Checklist Items 2.a and 2.b)

 Containment Health Assurance/Boric Acid Extent-of-Condition Inspection (Restart Checklist Item 2.c and 2.d)

 System Health Assurance Inspection (Restart Checklist Item 2.d and 5.a)

 Program Effectiveness Inspection (Restart Checklist Items 3.a through 3.g)

Further special inspections will be conducted to address the other Restart Checklist Items. The scope and timing of these inspections will be discussed with you when your staff has accomplished relevant activities and is ready to support the inspection.

The enclosed inspection plan provides a summary of NRC baseline inspection activities that are planned through September 2003. Routine inspections performed by the resident inspectors are not listed due to their ongoing and continuous nature. In addition to the inspections listed in the enclosure, a Safety System Design and Performance Capability inspection (IP 71111.21),

a Permanent Plant Modifications inspection (IP 71111.17), and an Identification and Resolution of Problems inspection (IP 71152) were originally scheduled between July and December 2003. However, it is expected that the objectives of these inspections will be accomplished during the NRC evaluation of First Energys restart activities.

The schedule for conduct of these inspections will be re-evaluated following completion of the special inspections discussed above. Note that the baseline inspection schedule is more tentative later in 2003 and may be adjusted due to emerging performance issues at Davis-Besse or other Region III facilities. The inspection plan may be updated by the Davis-Besse Oversight Panel, either due to the need to reschedule planned inspections, or to add or delete inspections based on NRC assessment of your progress in addressing the items on the Restart Checklist. You will be notified of any changes in the inspection plan or schedule.

Lastly, the NRC has finalized Temporary Instruction TI 2515/148, "Inspection of Nuclear Reactor Safeguards - Interim Compensatory Measures," that will be used to review implementation of the Interim Compensatory Measures required by the NRC Security Order to all commercial nuclear power plants dated February 25, 2002. The schedule for this inspection is included in the enclosure.
