-RESOLUTION NO.02-259 RESOLUTION OF THE STAFFORD, COUNTY OF

OCEAN, STATE OF NEW

JERSEY, CONDEMNING' THE ACTIONS -OF, OYSTER, CREEK GENERATING STATION WHICH RESULTED IN -A, MASSIVE 'FISH KILL IN OYSTER CREEK WHEREAS, on September 23, 2002, Oyster Creek Generating Station conducted maintenance on a transformer and took dilution pumps offline, which resulted in the discharge of hot water into-Oyster Creek; and WHEREAS, the discharged hot water raised the temperature of the water to an unacceptably high temperature in Oyster Creek; and WIWHEREAS, because of the error by Oyster Creek Generating Station', an estimated 5838 fish from 23 species, including striped bass, menhaden, white perch, croakers and spot fish, were killed from the ensuing shock; and,,

, WHEREAS,.the governing body of the Township of Stafford demands that Oyster

ý-Creek Generating Station correct its procedures to prevent any future recurrences of this unfortunate action; and WHEREAS, the governing body also requests that the New Jersey Department of Environmental Protection hold Oyster Creek Generating Station and its parent company, Exelon Nuclear, liable for violating allowable temperatures and performing maintenance at a time when such maintenance is prohibited; and NOW, THEREFORE, BE IT RESOLVED by the governing body of the, Township of Stafford, County of Ocean, State of New Jersey, as follows:

1. That'the governing body'c6ndemns the actions of Oyster Creek Generating Station and its parent company, Exelon Nuclearin failing to perform its maintenance properly and taking its dilution pumps offline such that hot-,Watef discharged into the Oyster Creek shocked and killed an estimated 5,838 fish from 23 species.!

2. The governing body prevails upon the New Jersey Environmental Protection Agency to consider stricter regulations for scheduled maititenance at nuclear plants and to hold Oyster Creek Generating Station and its parent company, Exelon Nuclear, liable for violating allowable temperatures and performing maintenance'at a time when such maintenance is prohibited.

3. - That a certified copy of this' resohlition be fdkrarded to the Exelon Nuclear, Oyster Creek Generating Station, the Nuclear 'Regulatory-Commissidn and the New Jersey Department of Environmental Protection, 9th District and UIcey Township Committee.
