SUBJECT: REVIEW OF INDUSTRY GUIDELINES RELATED TO INTERIM

COMPENSATORY MEASURES ASSOCIATED WITH THE

OCTOBER 16, 2002, SECURITY ORDERS TO DRY STORAGE

INDEPENDENT SPENT FUEL STORAGE INSTALLATIONS

Dear Mr. Beedle:

The U.S. Nuclear Regulatory Commission (NRC) issued Orders dated October 16, 2002, for all

independent spent fuel storage installations using dry storage, to immediately implement interim

safeguards and security compensatory measures (ICMs). The Orders for each plant included a

safeguards information (SGI) attachment containing specific ICMs to be implemented by the

receiving licensee.

While the Orders and associated ICMs were being developed, the Nuclear Energy Institute

(NEI) Security Working Group (SWG) developed a draft industry guidance document involving

SGI to facilitate licensee implementation of the specific ICMs contained in the Orders. The

NRC staff held meetings with the NEI SWG at NRC headquarters specifically to discuss the

draft implementing guidance.

By letter dated October 18, 2002, NEI submitted three guidance documents entitled

Implementation Guidance for Interim Compensatory Measures for Independent Spent Fuel

Storage Installations (ISFSI) Using Dry Storage that are not Co-Located at an Operating

Reactor Facility for the Order Dated October 16, 2002, Implementation Guidance for Interim

Compensatory Measures for Independent Spent Fuel Storage Installations (ISFSI) Using Dry

Storage Located at an Operating Reactor Facility on the Owner Controlled Area for the Order

Dated October 16, 2002," and Implementation Guidance for Interim Compensatory Measures

for Independent Spent Fuel Storage Installations (ISFSI) Using Dry Storage Located Inside an

Operating Reactor Facility's Protected Area for the Order Dated October 16, 2002." The NRC

staff has completed its review of the NEI guidance dated October 18, 2002, and has

determined that it provides an acceptable method for licensee implementation of the ICMs.

Regulatory Issue Summary (RIS) 2002-12D, Independent Spent Fuel Storage Installations

Using Dry StorageNRC Threat Advisory And Protective Measures System, was issued with

the Orders. As discussed in the Order cover letters, the Orders do not obviate the need for

licensees to continue to meet and maintain the effectiveness of existing security measures

taken in response to the events of September 11, 2001. Those measures correspond to

Level III (Yellow) in RIS 2002-12D.
