SALEM NUCLEAR GENERATING STATION, UNIT NOS. 1 AND 2, EVALUATION OF RELIEF REQUEST SC-RR-E01 AND SC-RR-L01 (TAC NOS.
MB6096, MB6097, MB6101 AND MB6102)
Dear Mr. Keiser:
By letter dated July 8, 2002, PSEG Nuclear, LLC submitted twelve requests for relief from Section XI of the American Society of Mechanical Engineers Boiler and Pressure Vessel Code under the provisions of 10 CFR 50.55a(a)(3)(i). Among the requested reliefs were SC-RR-E01, a request to invoke the 1998 Edition including 1998 Addenda of IWE for class MC components, and SC-RR-L01, a request to invoke the 1998 Edition including 1998 Addenda of IWL for class CC components.
On September 26, 2002, the Nuclear Regulatory Commission (NRC) issued in the Federal Register (67 FR 60520) a final rule to amend its regulations in 10 CFR 50.55a. In part, the final rule incorporates by reference the 1998 Edition including the 1998 Addenda to Section XI, Subsections IWE and IWL. The rule is effective on October 28, 2002. Pursuant to 10 CFR 50.55a(g)(4)(iv), the use of the 1998 Edition including the 1998 Addenda of Subsections IWE and IWL are approved subject to the limitations and modifications listed in paragraph (b) of 10 CFR 50.55a. In a telephone call on or about October 4, 2002, Mr. Howard Berrick of your staff informed us that as a result of this rule change you will not be needing the relief requested in either SC-RR-E01 or SC-RR-L01. The NRC staff, therefore, will not evaluate these relief requests. This completes the NRC staffs efforts on TAC Nos. MB6096, MB6097, MB6101, and MB6102.
