DISCRIMINATION AGAINST QA AUDITOR FOR RAISING ISSUES REGARDING ACCESS AUTHORIZATION (OFFICE OF INVESTIGATIONS CASE NUMBER 2-2001-008)

Dear Mr.Moyer:

Enclosed for your information is the synopsis of the Nuclear Regulatory Commission (NRC)

Office of Investigations (OI) completed report regarding alleged discrimination against the Carolina Power and Light Company by an employee who filed a complaint with the U.S.

Department of Labor.

OI determined that there was insufficient evidence to substantiate the allegation of discrimination. We plan no further action with regard to this matter. Should you have any questions concerning this letter, please contact us.

In accordance with 10 CFR 2.790 of the NRCs "Rules of Practice," a copy of this letter and its enclosure will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRCs document system (ADAMS). SYNOPSIS The Office of Investigations, U.S. Nuclear Regulatory Commission, Region II, initiated this investigation on April 20, 2001, after a former principal analyst at Carolina Power and Light Company (CP&L) alleged he was the subject of employment discrimination as a result of his raising issues regarding the corporate security managers access authorization policies.

Based on the evidence-developed, testimony, and documentation, the allegation that a former CP&L principal analyst was the subject of employment discrimination for identifying issues regarding the corporate security managers access authorization policies was not substantiated.
