September 18, 2002 Mr. Lew W. Myers Chief Operating Officer FirstEnergy Nuclear Operating Company Davis-Besse Nuclear Power Station 5501 North State Route 2 Oak Harbor, OH 43449-9760
SUBJECT:
DAVIS-BESSE NUCLEAR POWER STATION, UNIT 1 - REPLY TO RESPONSE TO ORDER FOR INTERIM SAFEGUARDS AND SECURITY COMPENSATORY MEASURES (TAC NO. MB4120)
Dear Mr. Myers:
On February 25, 2002, the U.S. Nuclear Regulatory Commission (NRC) issued Orders modifying the operating licenses for the Davis-Besse Nuclear Power Station, Unit 1 to require compliance with the specified interim safeguards and security compensatory measures (ICMs).
The NRC staffs letter of May 13, 2002, addressed your earlier response to the Orders and granted, in response to your request, an extension of time until June 6, 2002, for your submission of the required response for ICM B.2.a. Your letter of June 6, 2002, provided your response to ICM B.2.a and also provided further responses to ICMs B.2.b and B.2.c.
The NRC staff has reviewed your responses to the ICMs listed above submitted by your letter of June 6, 2002 and finds that you have satisfied the current reporting requirements of the Order.
The NRC will determine the effectiveness of your implementation of the ICMs through on-site inspections. Pursuant to Section III.C.2 of the Order, you reported to the Commission by letter dated September 9, 2002, that you have achieved full compliance with the requirements described in Attachment 2 to the Order.
Please contact Jon Hopkins at (301) 415-3027 if you have any other questions on these issues.
Sincerely,
/RA/
