In accordance with 10 CFR 26.71(d), enclosed is Carolina Power & Light (CP&L) Company's and Florida Power Corporation's (FPC) semiannual Fitness For Duty (FFD) Program performance data for the above listed plants.

The enclosed report provides FFD Program performance data for personnel subject to the requirements of 10 CFR 26, for the period January 1, 2002 through June 30, 2002.

SUMMARY

OF MANAGEMENT ACTIONS Lessons Learned and Actions Taken Blind Sample Submittal Rate During the self-assessment of the Fitness For Duty (FFD) Program in April 2002, the assessor identified that the blind submittal rate for the third quarter of 2001 did not meet the rate specified in 10CFR26, which requires a 10% blind submittal rate per quarter to a maximum of 250 blind samples. The number of samples submitted was based on outage ramp-up projections from the Harris Nuclear Plant (HNP) & Crystal River 3 (CR3) sites. However, the number of tests significantly increased in the last two weeks of September and no additional blind samples were submitted. There were a total of 2878 tests conducted in the third quarter 2001, but only 227 blind samples were submitted. Corrective actions included establishing an automatic reminder in the last month of the quarter to evaluate the appropriate number of blind samples to be submitted.

Omission from NRC Report In the fourth quarterT2001_,on"e-CcR3 Pre-access -ti'atbr"FFD -itive-violation-or -marijuana.

(greater than 100ng/ml) was not coded properly in the internal database causing the test result to fail to appear on the report of positives used to compile statistics for the six-month summary report to the NRC for July-December 2001. This administrative error was identified during the self-assessment of the FFD program in April 2002. This individual was denied access according to procedures. The CR3 total positive test results should have been 11 pre-access, 0 random, 1 for-cause, and 0 other. Corrective actions included correcting the code in the database, notification to the NRC of the inadvertent omission, and documenting the error in this summary of management actions.

EFFECTIVENESS EVALUATION Fitness For Duty Program Performance Data Random testing is required to be performed at an annual rate of at least 50% of the workforce in accordance with 10 CFR 26.24(a)(2). The current six month reporting period random testing rate was approximately 27.39 % for Carolina Power and Light Company (CP&L) Plants (Brunswick, Harris, and Robinson) and 30% for Florida Power Corporation (FPC) Crystal River Plant. For CP&L, there were 787 random tests conducted with an average of 2873 workers eligible for testing. For FPC, there were 238 random tests conducted with an average of 793 workers eligible for testing.

The total rate of positive test results for this reporting period for CP&L was approximately 1.05%. There were 20 positive results out of 1911 tests. The positive test results were comprised of 12 pre-access, 1 random, 4 for-cause, and 3 other. The total rate of positive test results for this reporting period for FPC was approximately 0.61 %. There were 2 positive results out of 329 tests. The positive test results were comprised of 0 pre-access, 2 random, 0 for-cause, and 0 other. Unescorted access for the individuals with confirmed positive tests was denied or revoked, as applicable.

For this reporting period for CP&L, the positive test rate for employees was 0.29%, with 2 posiFive result*ou6-"U f 682-tests. F60- FPCthe-positive-test -rate -for employees-was -

0.44% with 1 positive result out of 225 tests.

For this reporting period for CP&L, the positive test rate for contractors was approximately 1.46% with 18 positive results out of 1229 tests. For FPC, the positive test rate was 0.96 % with 1 positive test out of 104 tests.

There were no unsatisfactory blind performance tests during the reporting period.
