MID-CYCLE PERFORMANCE REVIEW AND INSPECTION PLAN -

CALVERT CLIFFS NUCLEAR POWER PLANT

Dear Mr. Katz:

On August 6, 2002, the NRC staff completed its mid-cycle plant performance assessment of Calvert Cliffs Nuclear Power Plant. In accordance with NRC Inspection Manual Chapter 0305 Operating Reactor Assessment Program, the mid-cycle review involved the participation of all technical divisions in evaluating the performance of the Calvert Cliffs facility for the first half of the current assessment cycle, January 1 - December 31, 2002. The purpose of this letter is to inform you of our assessment of your safety performance during this period and our plans for future inspections at your facility so that you will have an opportunity to prepare for these inspections and to inform us of any planned inspections which may conflict with your plant activities.

Plant performance for the most recent quarter was within the Degraded Cornerstone Column of the NRCs Action Matrix, based on the Unit 1 finding of substantial safety significance (Yellow) in the mitigating systems cornerstone. This finding was associated with the May 16, 2001, failure of the No. 11 turbine-driven auxiliary feedwater (AFW) pump. Calvert Cliffs Unit 2 was within the Regulatory Response Column of the Action Matrix based on one inspection finding of low to moderate safety significance (White). This finding applies to both units and was associated with the May 23, 2002, shipment of radioactive material to a waste processing facility, which was not properly prepared, resulting in an external radiation limit being exceeded.

The Unit 1 Yellow inspection finding associated with the pump failure was identified during a Special Inspection (reference Inspection Report 50-317/01-09, dated August 24, 2001) conducted in June-July 2001. A 95002 supplemental inspection (reference Inspection Report 50-317/01-13, dated January 14, 2002) identified that the Calvert Cliffs staff had adequately identified the underlying causes for the failed AFW pump and that the corrective actions were appropriately broad to provide reasonable assurance that failure would not recur. Therefore, at the end of the third quarter of 2002, the finding will no longer be considered in assessing plant performance.

The Unit 1 and 2 White inspection finding associated with the May 23, 2002, shipment of radioactive material was identified during an inspection (reference Inspection Report 50-317/02-04, 50-318/02-04, dated August 24, 2001) conducted in June 2002. We understand that your staff has initiated corrective actions regarding this finding. Therefore, we have scheduled

supplemental inspection procedure 95001 to be conducted in October 2002, to address this finding, in accordance with the NRC Manual Chapter 0305, Action Matrix. This inspection procedure is conducted to provide assurance that the root and contributing causes of risk-significant performance issues are understood, the extent of condition is identified, and the corrective actions are sufficient to prevent recurrence.

During the most recent quarter, one Unit 1 performance indicator (PI), AFW system unavailability, crossed the threshold from Green to White (increased regulatory response band) in the mitigating systems cornerstone. Although the AFW system unavailability stemmed largely from the above-noted AFW pump failure, the indicator crossed the threshold in the past quarter due to the way the recent extended refueling outage factored into system unavailability calculations. The PI is expected to return to Green during the third quarter. No supplemental inspection will be conducted for this PI, since it does not reflect recent performance, and follow-up was already conducted regarding the AFW system Yellow finding.

The Unit 1 Scram with Loss of Normal Heat Removal PI has been White since the first quarter of 2000. This PI, in the initiating events cornerstone, may return to Green as early as the third quarter of 2002. Follow-up inspection for this White PI has already been completed satisfactorily.

In our Annual Assessment Letter dated March 4, 2002, we advised you of a substantive cross-cutting issue in the area of Problem Identification and Resolution. Specifically, the staff had identified seven findings in the mitigating systems cornerstone in which Calvert Cliffs personnel did not consistently and thoroughly assess degraded or non-conforming structures, systems, and components. No new examples have been identified in our recent inspections, which may indicate that you are making progress in this area. However, our mid-cycle assessments review findings over a twelve month period, and over that period, the findings still reflect the same cross-cutting theme. Accordingly, the Problem Identification and Resolution inspection scheduled for November 2002, as well as other baseline inspections, will provide a basis for an NRC determination in the next annual assessment letter of whether you have effectively addressed this cross-cutting issue.

The enclosed inspection plan details the inspections scheduled through September 30, 2003.

The inspection plan is provided to minimize the resource impact on your staff, and to allow for scheduling conflicts and personnel availability to be resolved in advance of inspector arrival on site. Routine resident inspections are not listed due to their ongoing and continuous nature.

The last six months of the inspection plan is tentative and may be revised at the end-of-cycle review.

In addition, the NRC is in the process of finalizing a Temporary Instruction (TI) that will be used to review implementation of the Interim Compensatory Measures required by the Agencys Security Order to all commercial nuclear power plants dated February 25, 2002. Schedules have not yet been finalized, but it is anticipated that these inspections will begin within the next calendar quarter. Once finalized, the details will be communicated by separate correspondence.

In accordance with 10 CFR 2.790 of the NRCs Rules of Practice, a copy of this letter and its enclosure will be made available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's
