SUBJECT:
MILLSTONE NUCLEAR POWER STATION, UNIT NO. 2, INITIATION AND CLOSEOUT OF TAC FOR POTENTIAL NOED (TAC NO. MB5628)
This memorandum documents the initiation and closeout of TAC No. MB5628. This TAC was used for the time spent in preparation for a potential Notice of Enforcement Discretion (NOED) for Millstone Nuclear Power Station, Unit No. 2 (MP2). On July 18, 2002, at approximately 11:00 am, Mr. David Smith, the Regulatory Affairs Manager, for Dominion Nuclear Connecticut, Inc. (DNC or the licensee) at MP2, called to state that DNC believed they had missed performing a surveillance requirement (SR) on the Reactor Coolant System (RCS) thermocouples during the last refueling outage in the spring of 2002. These thermocouples provide input to the Thermal Margin/Low Pressure trip circuitry in the Reactor Protection System with the SRs as shown in Technical Specification (TS) Table 4.3-1.
The licensee stated that they had invoked SR 4.0.3 which allows 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> to consider action prior to the shutdown requirements stated in Limiting Condition for Operation (LCO) 3.0.3.
During this 24 hour2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> period, they planned to submit a NOED request along with a license amendment application that would allow a delay period, before entering an LCO, for a missed surveillance. The proposed amendment and NOED justification would be consistent with recent industry initiatives regarding missed surveillances using the consolidated line item improvement process (CLIIP). Approval of the NOED and associated amendment would allow the licensee until the next refueling outage to perform the RCS thermocouple surveillances.
Prior to formally requesting the NOED or submitting the license amendment request, the licensee determined that they found sufficient data on the plant computer to satisfy the RCS thermocouples SRs. At approximately 6:00 pm on July 18, 2002, Mr. David Smith notified me that a NOED would not be required.
