NORTH ANNA POWER STATION, UNITS 1 AND 2 AND INDEPENDENT SPENT FUEL STORAGE INSTALLATION (ISFSI), AND SURRY POWER STATION, UNITS 1 AND 2 AND ISFSI - TERMINATION OF REVIEW OF APPLICATIONS FOR ORDER AND CONFORMING LICENSE AMENDMENTS FOR LICENSE TRANSFERS (TAC NOS. MB2176, MB2177, MB2212, AND MB2213)
Dear Mr. Christian:
By letters dated June 7 and July 2, 2001, you applied for orders consenting to the transfer of the Facility Operating and Special Nuclear Material Licenses for North Anna and Surry Power Stations, Units 1 and 2, and their associated ISFSIs. As noted in these letters, VEPCO submitted these applications to comply with the electric industry restructuring laws in the Commonwealth of Virginia. The staff was requested to complete their review and issue a consenting order before November 30, 2001. In a subsequent letter dated January 30, 2002, VEPCO notified the staff that the State Corporation Commission (SSC) of Virginia had issued an Order denying VEPCOs request to conduct this transfer. As a result, VEPCO has filed a Notice of Appeal of the SSCs decision. This appeal process is not expected to be completed until November 2002.
The staff has decided to terminate our review of this activity and close out TAC Nos. MB2176, MB2177, MB2212, and MB2213. Please inform us by letter when you have completed the appeal process and we will reinstate our review.
