Request for Extension of Time to Submit an Answer and Request a Hearing Gentlemen:
By Reference 1, Oconee Nuclear Station submitted its response to the Interim Safeguards and Security Compensatory Measures Order ("Order") issued by the United States Nuclear Regulatory Commission ("NRC") on February 25, 2002 for Oconee Nuclear Station Units 1, 2 and 3. By Reference 2, Oconee submitted a request for an extension of time in which to request a hearing. A conference call was held on April 16, 2002 with members of the NRC to discuss our response to the Order. As a result of that call, the Oconee Nuclear Station is providing the NRC with additional details to support the review of the Oconee response.
NOTICE: Attachment 1 to this letter contains "SAFEGUARDS INFORMATION." Upon separation of the, this letter is "DECONTROLLED."

SAFEGUARDS INFORMATION U.S. Nuclear Regulatory Commission Page 2 May 1, 2002 The Oconee response and schedule for achieving compliance is based on expectations and guidance as documented in the March 8, 2002 letter from NEI to Chief Nuclear Officers providing Security Order Guidance. This guidance was determined to be an acceptable method for licensee implementation of the interim compensatory measures. to this letter provides an expanded response to the Interim Compensatory Measure B.5.d identified in the conference call on April 16, 2002. Additionally, during the call the NRC requested clarification on the extension requested in Reference 2. At this time, Oconee Nuclear Station does not request an extension of time to supplement the response to the Order. As detailed in our answer to the Order (Reference 1), the evaluation required by Interim Compensatory Measure B.2.a (1) will be completed by June 1, 2002. The requirements of Interim Compensatory Measure B.2.a (2) will be completed in a timely manner, but not later than August 31, 2002. However, upon completion of the evaluation required by Interim Compensatory Measure B.2.a (1) we reserve the right to request a hearing to address potential implementation issues associated with Interim Compensatory Measure B.2.a (2).
Attachment I to this letter contains safeguards information, as defined in 10 C.F.R. § 73.21.
Duke Energy Corporation therefore requests that Attachment 1 be withheld from public disclosure.
