SUMMARY

OF LICENSE RENEWAL MEETING BETWEEN THE U.S.

NUCLEAR REGULATORY COMMISSION (NRC) STAFF AND THE NEI LICENSE RENEWAL WORKING GROUP; FPL FOR THE TURKEY POINT NUCLEAR PLANT, UNITS 3 AND 4, AND THE ST. LUCIE NUCLEAR PLANT, UNITS 1 AND 2; VEPCO FOR THE SURRY AND NORTH ANNA POWER STATIONS, UNITS 1 AND 2; DUKE FOR THE MCGUIRE AND CATAWBA NUCLEAR STATIONS, UNITS 1 AND 2; EXELON FOR THE PEACH BOTTOM ATOMIC POWER STATION, UNITS 2 AND 3; AND OPPD FOR THE FORT CALHOUN STATION, UNIT 1 A meeting was held on April 8, 2002, to discuss the status of license renewal activities. The meeting began with discussions between the NRCs License Renewal Steering Committee and NEIs License Renewal Working Group on the general status of license renewal applications and generic license renewal activities. The meeting continued with discussions between NRC management and FPL (Turkey Point and St. Lucie), VEPCO (Surry and North Anna), Duke (McGuire and Catawba), Exelon (Peach Bottom), and OPPD (Fort Calhoun) regarding the progress of the license renewal application reviews. Attendees at the meeting are listed in . The meeting agenda and the NRC staffs presentation materials are contained in Attachment 2. The following is a summary of the discussions between the NRC and the stakeholders.

MEETING BETWEEN THE NRC LICENSE RENEWAL STEERING COMMITTEE AND NEI LICENSE RENEWAL WORKING GROUP Status of Applications Representatives of FPL, VEPCO, Duke, Exelon, and OPPD provided summaries of the Turkey Point, St. Lucie, Surry, North Anna, McGuire, Catawba, Peach Bottom, and Fort Calhoun license renewal application reviews, which were subsequently discussed in more detail during the management portion of the meeting (see summaries below).

License Renewal Interest - Known Submittals Slide 1 of Attachment 1 shows the latest information the NRC has regarding licensee plans for submitting license renewal applications. No changes to these plans were identified at the meeting.

Mr. David Matthews, NRC, recommended that licensees planning on submitting a single license renewal application for similar plants owned by different companies should meet with the NRC staff prior to committing resources to such a project. He noted that several issues related to hearings, timing of the submittal, and issuance of a single renewal license need to be explored.

License Renewal Implementation Guidance Development Dr. Pao-Tsin Kuo, NRC, summarized the status of emerging issues and described the process for developing and documenting interim staff guidance. He explained that the positions presented in the interim staff guidance would be incorporated into future revisions of the license renewal generic guidance documents.

Mr. Michael Tuckman, Duke, stated that the industry was concerned about maintaining a stable environment for the license renewal process. He explained that the industry does not agree with the NRC staff positions related to reliance on offsite electrical systems during station blackout conditions or to the inspection requirements for concrete structures. However, the industry does not intend to appeal the staff positions since licensees already have existing programs for managing the related aging effects. Mr. Tuckman noted that even though the increased regulatory burden of each interim staff position is small, the cumulative effect may become burdensome. He suggested that NRC management review each new interim staff position in accordance with an established process and in relationship to regulatory accretion.

Mr. Jon Johnson, NRC, explained that the staff is obligated to resolve any new potential safety issue. Mr. William Borchardt, NRC, stated that each issue is resolved on its own merits. Dr.

Kuo noted that the staff and NEI have been meeting to formalize a process for issuing interim staff guidance.

Lessons Learned from Application Reviews Dr. Kuo described the lessons learned from the initial acceptance review of the Fort Calhoun license renewal application. He noted that the Fort Calhoun application was the first to follow the format of the standard review plan and incorporate staff guidance from the demonstration project. Dr. Kuo explained that the staff identified a lack of linkage between the structures and components identified as requiring aging management and the applicable aging management programs. As a result, the applicant provided supplemental information that identified the links.

Future license renewal applicants are considering submitting similar information with their applications.

Dr. Kuo described an issue concerning how aging management programs described by the Generic Aging Lessons Learned (GALL) report should be referenced in applications. He explained that the staff will develop a proposed interim position that will be provided to industry for comments.

Mr. Tuckman suggested that the NRC plan a license renewal workshop in the fall of 2002 for licensees who intend to submit license renewal applications in CY-2003. He also suggested that the NRC develop administrative guidance on how to implement interim staff positions on emerging issues for license renewal applications that are in different stages of review and approval.

The NRC staff responded that implementation of interim staff positions should be handled consistent with other regulatory procedures, such as, late filed allegations and generic safety issues. Mr. Johnson stated that the staff first needs to reach a decision on an issue and then determine how to implement the decision.

Summary Mr. Tuckman stated that the industry was still interested in developing an appeals process and was waiting for the staff to respond to comments by the NEI. He noted that the industry and staff had met all the milestones for past and present license renewal application reviews. He complemented the staff for its formality of working through emerging issues and allowing public participation in the process.

Mr. Jon Johnson stated that license renewal is one of the Commissions highest priorities.

Public Participation No member of the public chose to participate in the meeting.

MEETINGS BETWEEN NRC MANAGEMENT AND LICENSE RENEWAL APPLICANTS Florida Power and Light Company -- Turkey Point 3 & 4, and St. Lucie 1 & 2 FPL presented the status of the license renewal application reviews for Turkey Point and St.

Lucie (Attachment 3). The applicant stated that the staff had issued the Generic Environmental Impact Statement and Safety Evaluation Report (SER) for Turkey Point. Also, the Advisory Committee on Reactor Safeguards (ACRS) toured the site and held a subcommittee meeting.

The applicant noted the following upcoming activities: ACRS issuance of a report, staff issuance of the SER as a NUREG, and Commission issuance of a decision. The applicant expressed concern with the implementation of the staff interim guidance for station blackout and its impact on the schedule.

The applicant stated that the St. Lucie license renewal application had been accepted for review and that no hearing requests had been filed. The NRC began its scoping and screening methodology audit and conducted an environmental scoping meeting. The applicant noted the following upcoming activities: onsite scoping and screening methodology audit and issuance of environmental and safety requests for additional information. The applicant summarized that license renewal activities are on schedule, communications between FPL and NRC occur frequently, and the NRC is revising the license renewal application review schedule based on no hearing requests.

Virginia Electric and Power Company -- Surry 1 & 2 and North Anna 1 & 2 VEPCO provided an update of the progress of the Surry and North Anna license renewal application reviews (Attachment 4). The applicant stated that communication continues to be frequent and productive and have resulted in reaching closure on most issues. The staff has completed the scoping inspections and the walkdown of the Surry Containment. The applicant identified station blackout scoping, work control aging management, and metal fatigue of charging and safety injection piping as open issues. The applicant noted the following upcoming activities: aging management review inspections, issuance of the draft Environmental Impact Statements, public meeting, and issuance of the SER with open items. The applicant summarized that the development of the SER continues with open dialogue on issues requiring more information.

Duke Energy Company -- McGuire 1 & 2 and Catawba 1 & 2 Duke provided an update of the progress of the McGuire and Catawba license renewal application review (Attachment 5). Duke discussed recent accomplishments in the safety and environmental reviews and the hearing process, indicating that responses to the staffs requests for additional information (RAIs) were being finalized for submittal by April 15, 2002.

Duke also provided assessments of the quality of the safety RAIs issued by the staff, noting that the overall quality was very good.

Duke indicated that the Atomic Safety and Licensing Board (ASLB) had admitted two contentions (proffered by Nuclear Information & Resource Service and the Blue Ridge Environmental Defense League) for hearing. These contentions pertain to Severe Accident Mitigation Alternatives and the potential use of mixed-oxide (MOX) fuel at the McGuire and Catawba nuclear stations. Duke added that this ASLB order was appealed by both Duke and the staff. Subsequently, the ASLB granted discovery and set a hearing date for the week of July 15, 2002, to address the MOX contention. Monthly status calls with the ALSB were initiated in February and will continue at the ASLBs discretion to facilitate preparation for the hearing.

The NRC staff added that OGC had filed a Motion for Stay on March 11, 2002, in response to the ASLBs order granting discovery and the evidentiary hearing scheduled for July, noting that Commission decisions pertaining to the appeals and the Motion for Stay are anticipated.

Exelon Generation Company -- Peach Bottom 2 & 3 Exelon provided an update of the progress of the Peach Bottom license renewal application review (Attachment 6). The applicant stated that the staff has issued environmental and safety RAIs. The applicant provided responses the the environmental RAIs on December 20, 2001.

The responses to the safety RAIs are due by May 27, 2002. The applicant noted the following upcoming activities: scoping and aging management review inspections. Exelon stated that emerging industry issues are challenging the stability and predictability of the license renewal process and may impact the Peach Bottom license renewal application review schedule. The applicant stated that the NRC staff appears to believe all GALL programs are required to manage aging effects. The applicant summarized that communications with the staff have been good and that license renewal standardization is being challenged.

Omaha Public power District -- Fort Calhoun OPPD provided an update of the progress of the Fort Calhoun license renewal application review. The applicant stated that it had submitted the supplemental information requested by the staff. The applicant indicated that the environmental review had started.
