THREE MILE ISLAND NUCLEAR STATION, UNIT 1 (TMI-1) RE: PEAK ROD AVERAGE POWER (TAC NO. MB3163)

Dear Mr. Skolds:

By letter dated August 22, 2001, you responded to a request for additional information (RAI) related to your January 23, 2001, License Amendment Request No. 249 for TMI-1. In that letter you identified that for a few fuel assemblies, the peak rod average power would exceed the guideline of 6.3 kw/ft (kilowatts per foot) specified in Regulatory Guide (RG) 1.183, Section 3.2, Table 3, footnote 11, for a few days at the end of TMI-1 Operating Cycles 13 and 14. You also indicated that you had performed a bounding assessment of the affect of this condition and concluded that the calculated doses remained well within the limit specified in RG 1.183 and Title 10 of the Code of Federal Regulations (10 CFR), Section 50.67. The Nuclear Regulatory Commission (NRC) staff performed a confirmatory assessment of the affect of this condition and requested by letter dated December 12, 2001, that you provide gap release fractions for fuel assemblies exceeding 54 GWD/MTU (gigawatt days per metric ton uranium) burnup and 6.3 kw/ft linear heat generation rate using the American National Standards Institute (ANSI)/ANS Standard 5.4, Methods for Calculating the Fractional Release of Volatile Fission Products From Oxide Fuel.

You responded to the NRC RAI by letter dated February 15, 2002. You recalculated the fission product release fractions using the methodology described in ANSI/ANS 5.4 assuming a peak rod average power of 8.0 kw/ft which bounds the worst case Cycle 13 and 14 fuel assembly peak rod average power of 7.1 kw/ft. You also conservatively assumed that the high power fuel rods would operate at burnups in excess of 54 GWD/MTU for 60 days achieving burnups of 57 GWD/MTU.

The NRC staff has determined that your assumptions for peak rod average power and maximum burnup are conservative and therefore, acceptable. Further, the NRC staff has reviewed the gap release fraction recalculated by your staff and determined that you have demonstrated that the assumption previously made in the bounding assessment to double the release fractions for high burnup was more conservative relative to the recalculation performed using the ANSI/ANS 5.4 methodology. Therefore, the NRC staff concludes that there is reasonable assurance that the radiological dose calculation supporting License Amendment Request No. 249, wherein you assumed a doubling of the fission product release fractions, still bounds the radiological consequences of a postulated design-basis fuel handling accident. The
