Comanche Peak Steam Electric Station (Docket Nos. 50-445; 50-446)

ISSUANCE OF THE FINAL SIGNIFICANCE DETERMINATION FOR A WHITE FINDING AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation associated with a White Significance Determination Process (SDP) finding will be issued on or about February 21, 2002, to TXU Electric. This White finding was the result of the staff's assessment of the significance of 11 examples in which items containing detectable radioactivity were unconditionally released from a radiologically controlled area (RCA) at Comanche Peak Steam Electric Station (CPSES). This violated Technical Specification-required procedures at CPSES, which allow no detectable activity in material unconditionally released from an RCA. Each of the 11 examples involved items containing low levels of contamination, and did not pose a significant radiological hazard.

However, these events revealed a potentially unmonitored pathway for radioactive material to be released from the facility, and the NRC's Public Radiation Safety SDP considers the extent to which a licensee has formal and systematic controls in place to prevent radioactive material from entering the public domain. Thus, public confidence in the control of radioactive material is an implicit feature of the SDP. The NOV associated with this finding covered 9 of the 11 examples. A previously issued inspection report documented non-cited violations (NCVs) for the remaining two events.

It should be noted that the licensee has not yet been specifically informed of the enforcement action. The schedule of issuance and notification is:
