Dear Congressman McHugh:

On behalf of Chairman Meserve, I am responding to your letter of December 3, 2001, in which you asked that the Nuclear Regulatory Commission (NRC) consider a request from Mr. Timothy Judson of the Citizens Awareness Network for the NRC to hold a community meeting in Oswego County in the near future. The purpose of this meeting would be to discuss the potential threats to local safety and national security in the event that the FitzPatrick and Nine Mile Point facilities become the possible targets of a terrorist attack.

The NRC is committed to keeping the public, particularly citizens who live near nuclear power facilities, informed on matters pertaining to the public health and safety through various measures including the NRC Web site and plant performance assessment meetings under the Reactor Oversight Program. In the case of Nine Mile Point and FitzPatrick, we plan to hold management meetings, open for public observation, early this spring to discuss licensee performance at both facilities. It is our normal practice following such meetings to receive questions and comments from the public.

We have received a large number of requests since the September 11, 2001, attacks to address security-related questions in a variety of forums. We regret that we are not able to accommodate all of these meetings due to the overall press of business and limits on available resources. Thus we cannot support this request without adversely impacting critical safety inspection activities and other oversight functions. However, if Mr. Judson has specific concerns regarding reactor safety and security, he is encouraged to raise his concerns to our Region I office by phone at (610) 337-5000. In addition, we will inform him of the dates of the plant performance assessment meetings at Nine Mile Point and FitzPatrick this spring.
