SUMMARY

OF LICENSE RENEWAL MEETING BETWEEN THE U.S. NUCLEAR REGULATORY COMMISSION (NRC) AND THE NEI LICENSE RENEWAL WORKING GROUP; ENTERGY FOR ARKANSAS NUCLEAR ONE, UNIT 1 (ANO-1); SNC FOR HATCH NUCLEAR PLANT, UNITS 1 AND 2 (HATCH); AND FPL FOR TURKEY POINT UNITS 3 AND 4 A joint meeting was held on November 29, 2000, to discuss generic renewal activities and the status of license renewal applications under review by the NRC. The meeting began with discussions between the NRC's License Renewal Steering Committee (LRSC) and NEI's License Renewal Working Group on the general status of license renewal applications and generic license renewal activities.

The meeting continued with discussions between NRC management and Entergy, SNC, and FPL regarding the reviews of the ANO-1, Hatch, and Turkey Point license renewal applications, respectively.

Attendees at the meeting are listed in Attachment

1. The agenda for the meeting is provided as Attachment
2. Following is a summary of the discussions at the meeting: I. NRC LRSC -NEI Working Group A. Status of applications Entergy, SNC, and FPL provided summaries of the ANO-1, Hatch, and Turkey Point license renewal application reviews, which were subsequently discussed in more detail during the management portion of the meeting (see summaries below). Communications continue to be good and the reviews of the applications are on or ahead of schedule.

B. License renewal interest (1) Current licensee interest The chart in Attachment 3 shows the latest information the NRC has regarding licensee plans for submitting license renewal applications.

The importance of licensees informing the NRC of plans for submitting renewal applications was again stressed.

Because of the number of resources involved in reviewing an application, this information is crucial to the NRC's planning and budgeting process. The "TBDs" on the attached chart are open slots for applications based on previous budget assumptions.

However, the NRC currently has no indication of any licensee interest for these slots and will be reassessing maintaining these open slots as part of its current budget activities. (2) Regulatory Information Summary status At the July 20, 2000, NRC -NEI meeting, the industry discussed the business sensitivity of renewal plans for some licensees and the reluctance to submit this information to the NRC. In response to industry concerns regarding maintaining the information confidential, the NRC prepared and issued to all holders of operating licenses, Regulatory Issue Summary 2000-20, "Importance of Industry Providing NRC Advance Notice of Intent to Pursue License Renewal." This summary discusses the importance of informing the NRC of license renewal plans and describes the process for requesting the information be controlled as proprietary due to its confidential financial or commercial nature. NEI acknowledged the NRC's ability to maintain the information as proprietary but indicated that licensees are still reluctant to provide the information which would have to be disclosed if requested by Congress.

C. New lessons learned from application reviews -Categorization of RAIs At previous meetings, NEI had proposed an activity to assist in improving the request for additional information (RAI) process by having applicants review and categorize the RAls received from the staff. Entergy and SNC have categorized the RAls that have been received using seven categories and will provide this information to the NRC for discussion at future meetings.

The results of the review can then be used to better understand the validity and effectiveness of the RAIs developed by the staff and its contractors and better focus the RAI process and achieve efficiencies for the future. D. License renewal implementation guidance development (1) Categorization of public comments Attachment 4 summarizes the public comments received on the license renewal implementation guidance documents (license renewal standard review plan (SRP), regulatory guide (RG), and Generic Aging Lessons Learned (GALL) Report). Of the written comments received from 126 commenters, approximately 100 were from individuals responding to a news article that incorrectly characterized the public comment period on the guidance documents as the only opportunity for public involvement before the NRC generically renewed the licenses of operating licenses.

The NRC staff has clarified the intent of the public comment period to these commenters and is currently evaluating the remainder of the comments and is meeting with industry to discuss open items. (2) Improved renewal guidance schedule status The schedule for issuing the revised guidance documents is contained in Attachment

5. NEI discussed a topic that it raised with the Commission at the December 4, 2000, briefing.

NEI stated that dialogue between the staff and industry has been good in developing the current version of the Generic Aging Lessons Learned (GALL) report and the license renewal standard review plan (SRP). However, the industry expected the GALL report to be a compilation of the lessons learned from the Calvert Cliffs and Oconee reviews reflecting where existing programs were found acceptable.

Instead, NEI stated that few existing programs match exactly all of the attributes for the programs listed in the GALL report and that it may be of limited use to future applicants, that the report is too detailed and prescriptive, and that the industry is uncertain how to use the report in preparing a renewal application.

The NRC staff responded that lessons learned from the first reviews were considered in developing the GALL report, but programs may differ from those approved for the first applicants because these applicants used different plant-specific programs.

The detail in the report is provided to ensure consistency in applicant's use and staff reviews in order to obtain efficiencies for future reviews. A number of industry concerns involve uncertainty regarding how the staff will use the GALL report in performing reviews. The industry's implementation concerns regarding staff use of the GALL report have been discussed in the past between the staff and industry and the staff expects to continue these discussions.

The staff also plans to include additional clarification on the use of the GALL report in the SRP. NEI also indicated an option to use a "demonstration" of plant examples to work through the implementation issues. I1. NRC Mangement

-License Renewal ADplicants A. Entergy Operations, Inc. -ANO-1 The NRC staff and Entergy noted the accomplishments for the review of the ANO-1 license renewal application.

The staff and the applicant have met or exceeded all scheduled milestones to date for the review of the application.

The staffs presentation materials are contained in Attachment 6 and Entergy's in Attachment

7. The staff noted that since the last management meeting on September 26, 2000, the staff issued the draft supplemental environmental impact statement (DSEIS) approximately 2 months ahead of schedule.

As a result of the early release of the DSEIS, the staff held the second public meeting relating to the DSEIS on November 14, 2000, in Russelville, Arkansas.

The staff reported that the meeting went well without any noted objections to the ongoing license renewal activities.

Two milestones will come due prior to the next management meeting, the scoping inspection was scheduled to take place and was subsequently completed during the week of December 11, 2000, and the technical safety evaluation report with open items is scheduled to be released by January 10, 2001. Entergy provided a similar summary. They were pleased with the progress being made on the review of the ANO-1 renewal application and the level of communication between the NRC and their staff. They also discussed their willingness to continue to work with the staff on potential open items relating to the safety evaluation.

B. Southern Nuclear Operating Company, Inc. -Hatch The staff and SNC noted the accomplishments over the last 2 months for the review of the Hatch license renewal application.

The staff and SNC have met or exceeded all scheduling milestones to date for the review of the application.

9. The staff noted that since the last management meeting in September, two milestones had been completed:

SNC provided the remaining responses to the staff safety review requests for additional information on October 10, 2000, and the DSEIS was issued on November 3, 2000. In addition, on October 5, 2000, the staff held its public exit meeting at the Hatch site for both the scoping and screening audit and the scoping inspection (the scoping inspection report was issued on November 1, 2000). Upcoming activities and milestones discussed included the public meeting to discuss the DSEIS (subsequently held on December 12, 2000), submittal of the annual update (submitted by letter dated December 15, 2000), and the issuance of the safety review safety evaluation report with open items (scheduled for February 8, 2001). It was noted that the treatment of certain active components (fans and dampers) and complex assemblies, as well as the treatment of seismic Il/I piping systems are being addressed by the staff and SNC. In addition, SNC requested that the NRC continue to evaluate the feasibility of providing a fee waiver for a portion of the review activities associated with the Hatch renewal application review. C. Florida Power and Light Company -- Turkey Point The NRC staff presented the status its review of the Turkey Point license renewal application that was received on September 11, 2000. This was the first management meeting on the Turkey Point application.

11. The acceptance review of the application was completed and noticed in the Federal Regqister on October 12, 2000, with November 13, 2000 as the deadline for filing a request for a hearing and petition for leave to intervene in the proceeding.

By order dated November 6, 2000, the Secretary of the Commission extended this date to November 27, 2000, for one individual.

A total of two petitions for hearing were subsequently submitted on this license renewal application.

An Atomic Safety and Licensing Board has been established to preside over the proceedings.

In an order issued on November 27, 2000, the Commission directed the Board to decide within 90 days whether the two petitions for hearing will be granted. The Order further stated that if a hearing is granted, the Board should set a schedule for conducting the hearing with a goal to issue a Commission decision on the license renewal application in about 30 months. The review schedule for the application was discussed and the next milestones are the transmittal of all requests for additional information by February 5, 2001, and to conduct the public environmental scoping meeting scheduled for December 6, 2000 (subsequently completed).

To date, no major technical issues have been identified.
