REGULATORY GUIDE 7.5 ADMINISTRATIVE GUIDE FOR OBTAINING EXEMPTIONS FROM CERTAIN NRC REQUIREMENTS OVER RADIOACTIVE MATERIAL SHIPMENTS A. INTRODUCTION The Commission's regulation, 10 CFR Part 71, "Packaging of Radioactive Material for Transport and Transportation of Radioactive Material Under Certain Conditions," applies to licensees of the Commission who transport licensed material or who deliver licensed material to a carrier for transport. In their transport or delivery of packages of radioactive material, licensees who are not subject to Department of Transportation (DOT) regulations may be required by 10 CFR 71.5(b) to conform to certain standards and requirements of the DOT. This regulatory guide describes a method accept able to the NRC staff for licensees of the Commission to comply with paragraph 71.5(b) with respect to obtaining exemptions or waivers from certain requirements of the DOT regulations. As specified in paragraph 71.5(b),

requests for exemptions from requirements of the DOT regulations, in those cases where they are imposed by the provisions of paragraph 71.5(b), must be filed with the Nuclear Regulatory Commission.

B. DISCUSSION Subcommittee N14.10 on Administration of the Regulations of the American National Standards Institute (ANSI) has developed a guide to the procedures to follow and the standards to satisfy in order to obtain an exemption from certain parts of the DOT regulations.

information to be included in a request for such an exemption, the office to which the request should be submitted, and the period of time that should be allowed for the processing of the request. The guide was approved by ANSI on June 22, 1973.

C. REGULATORY POSITION The guidance contained in ANSI N14.10.2-1973, "Administrative Guide for Obtaining Department of Transportation Special Permits for Radioactive Material Shipments," is generally acceptable to the NRC staff for use by Commission licensees in obtaining NRC approval of an exemption from the requirements of DOT regula tions, as they are imposed by the provisions of 10 CFR 71.5(b) subject to the following exceptions:

Department of Transportation as the appropriate agency to which a request for exemption should be referred, the appropriate agency for purposes of this regulatory guide is the U. S. Nuclear Regulatory Commission.

2. The address to which a request for exemption should be submitted for purposes of tis regulatory guide is Director, Office of Nuclear Materials Safety and Safeguards, U. S. Nuclear Regulatory Commission, Washington, D.C. 20555.

D. IMPLEMENTATION This regulatory guide may be used upon issuance by any person submitting an application for exemption pursuant to paragraph 71.5(b) of 10 CFR Part 71. Other effective means of providing information to justify the requested exemption also may be used.
