SUBJECT:

Withdrawal of Request for Hearing on Interim Safeguards and Security Compensatory Measures Order On March 15, 2002, Omaha Public Power District (OPPD) submitted its answer to the Interim Safeguards and Security Compensatory Measures Order (hereinafter "Order") as Reference 3. In Reference 3, OPPD requested a hearing and specified that OPPD would withdraw its request for a hearing upon its review of the Staff disposition of its exceptions to the Order with respect to Order Requirements B.2.a(2), B.2.d, and B.4.h. Reference 5 withdrew OPPD's request for an extension of time to respond to Order Requirement B.2.a(2) and indicated that OPPD intends to implement Order Requirement B.2.a(2). Per a telecon with the NRC dated May 15, 2002, the NRC documented its acceptance of OPPD's response to Order Requirements B.2.d and B.4.h.

Therefore, OPPD withdraws its request for a hearing.

Additionally, Reference 5 was inadvertently submitted with a date of March 26, 2002. The date of Reference 5 should have been April 26, 2002.
