Turkey Point Units 3 and 4 Docket Nos. 50-250 and 50-251 Wastewater Permit Number FL001562 Request for Clarification Notification In accordance with Section 3.2.3 of the Turkey Point Units 3 and 4 Environmental Protection Plan (Appendix B of Facility Operating Licenses DPR-31 and DPR-41), enclosed is a copy of the request for a letter of clarification to the Wastewater Permit Number FL001562. The permit clarification does not change the conditions or requirements of the permit, but only specifies that the radioactive component of the discharge is regulated by the U.S. Nuclear Regulatory Commission for Turkey Point Units 3 and 4.

Florida Power & Light Company Turkey Point Plant Wastewater Permit No. FL0001562

Dear Mr. Hubbard:

As discussed, FPL requests a letter of clarification for its Turkey Point Plant Industrial Wastewater permit FL0001562. This request does not change the conditions or requirements of the referenced permit, but does provide clarification with regards to the two nuclear units (Unit 3 and Unit 4) at the Turkey Point Plant. The requested clarification includes the addition of the following permit language.

"The radioactive component of the discharge is regulated by the U.S. Nuclear Regulatory Commission under the Atomic Energy Act, and not by the Department or the U.S.

Environmental Protection Agency under the Clean Water Act."

Please note that this language is included in FPL's St. Lucie Plant Industrial Wastewater permit FL0002208. The St. Lucie Plant also has two nuclear units (Unit 1 and Unit 2).
