requested temporary exemptions from certain requalification requirements for security personnel at Beaver Valley Power Station, Unit Nos. 1 and 2 (BVPS), Davis-Besse Nuclear Power Station, Unit No. 1 (DBNPS), and Perry Nuclear Power Plant, Unit No. 1 (PNPP).

By electronic mail dated May 6, 2020, the Nuclear Regulatory Commission (NRC) staff issued a request for additional information (RAI) to complete its review. The Energy Harbor Nuclear Corp. response is contained in the Attachment.

In order to complete the review of the exemptions, the Nuclear Regulatory Commission (NRC) requested additional information. The requested information is provided below in bold typeface, followed by the Energy Harbor Nuclear Corp. response.

Request for Additional Information

1. Pursuant to Section 73.5, Specific exemptions, of Title 10 of the Code of Federal Regulations (10 CFR), the Commission may, upon application by any interested person or upon its own initiative, grant exemptions from the requirements of 10 CFR Part 73 when the exemptions are authorized by law, will not endanger life or property or the common defense and security, and are otherwise in the public interest.

Pursuant to 10 CFR 73.5, the licensee requested temporary exemptions from certain periodic requalification requirements for security personnel in Section VI, Nuclear Power Reactor Training and Qualification Plan for Personnel Performing Security Program Duties, of 10 CFR 73, Appendix B. The licensee also stated it will require an exemption to the security and training requirements in Appendix B to Part 73 and associated items in the Beaver Valley, Davis-Besse, and Perry training and qualification plans. However, the Beaver Valley, Davis-Besse, and Perry training and qualification plans for security personnel are not contained within 10 CFR Part 73.

Confirm that EHNC [Energy Harbor Nuclear Corp.] is only requesting an exemption from the requirements in 10 CFR Part 73.
