Beaver Valley Power Station, Unit Nos. 1 and 2 BV-1 Docket No. 50-334, License No. DPR-66 BV-2 Docket No. 50-412, License No. NPF-73 Supplemental Response to Generic Letter 2003 Control Room Habitability (TAC Nos. MB9772 and MB9773)

In letter L-04-042 dated March 22, 2004, FirstEnergy Nuclear Operating Company (FENOC) described a schedule for submittal of a license amendment request proposing revisions to technical specification surveillance requirements related to control room envelope integrity. The proposed schedule was to submit the request within 180 days of NRC approval of Technical Specification Task Force (TSTF) change traveler TSTF-448. Change traveler TSTF-448 was subsequently made available through a Federal Register notice on January 17, 2007; therefore, the scheduled date for the amendment request was July 16, 2007.

On July 9, 2007, FENOC staff discussed the need to extend the schedule for submittal with the NRC project manager. At the time that the 180 day schedule was proposed, TSTF-448 was still under development and all aspects that would need to be addressed in the license amendment request were not fully understood. More preparation time for the license amendment request is needed to address Beaver Valley Power Station plant-specific licensing basis differences from the TSTF model. The license amendment request is currently in the final stages of review prior to submittal to the NRC and is expected to be submitted by August 31, 2007.

This change in schedule for satisfying the commitment described in the March 22, 2004 letter has been evaluated in accordance with FENOC procedures, consistent with NEI 99-04, "Guideline for Managing NRC Commitments." These guidelines indicate that the NRC should be notified by supplementing the correspondence containing the original commitment. Therefore, a revised commitment list reflecting the current schedule is provided in the attachment to this letter.

ATTACHMENT TO L-07-096 Commitment List The following list identifies those actions committed to by FirstEnergy Nuclear Operating Company for Beaver Valley Power Station (BVPS) Unit Nos. 1 and 2 in this letter. This commitment supersedes the previous commitment made in FENOC Letter L-04-042, dated March 22, 2004. Any other statements in this letter are provided for information purposes and are not considered regulatory commitments. Please notify Mr. Thomas A. Lentz, Manager - Licensing, at (330) 761-6071, of any questions regarding this document or associated regulatory commitments.

Commitment Due Date Submit a license amendment request to propose revisions to the August 31, 2007 technical specification surveillance requirements on both BVPS units to utilize a more direct measurement method (i.e., leak rate test) to verify control room envelope integrity and a periodic verification that a positive pressure is maintained between the control room envelope and adjacent areas with the control room emergency ventilation system in operation.
