Dear Sir:

l Reference 1 contains ai request for an exempion from the retest requirement of 10 CFR 50 Appendis J, heetion lil.A4(h). His exempion would eliminate the requircrr,ent for the Authority to perform a Type A primary contal' ament integrated leakage rate teg (ILRT) during the 19M refueling outage. Reference 1 described a containment iwlation vaht replaecment program which  :

the Autho.ity is implementing in order to improst the leakage characteristics of the FitiPaakk {

containment. This program is the key element of a proposed Correctist Actk n Plan (CAP) which is t the basis for the exempion request.

In Reference 1, the Authorhy informed the NRC that the llPCI turbine exhaust line manual  !

bkxk vaht (2MIPl.11) would be replaced during the 19M sefueling outage. The Authority subsequently identired the fact that replaecment of this sahr would create twu new wrlds in the primary containment pressare tuundary which could not be local lesk rate tested. The Authority

, then amended its exempicm request on July 14,19M (Referenec 2), to alkw initallation of this vahe ,

l without hasbg to perfori.: a Type A ILRT as otherwhc required by 10 CFR 50 Appendit J, Sutkm IV.A. At that time, the Authority dkl not reallic that a licenw amendment would also be required in additim to t $e exempions from Appendis J.

This propsed change to the Technical Specifwations is required prior to start up from the current 4

refucting outage. The Authority plans to :nJ the current refueling outage on November 18,19M ,

whkh is leu than 30 dap from the date of this applicatkus. The Authority requests that this  ;

application for amendment be processed on an emergency basis under the proshions of 10 CFR bY l'} l p

50.91(a;(5) since insuflicient time exists to pruide for a 30 day public comment perial without preventing the resumption of powtr operation.

Enclosed for filing is the signed original of a document entitled ' Application for Amendment to Operating License,' with Attachments I and il thereto, comprisir'g a statement of the proposed changes to the Technleal Specifications and the associated Safety Evaluation.

In accordance with 10 CFR 170.12, a check in the amount of $150.00 is encimed as payment of the application fee for the resiew of the proposed changes to the Technical Specifications.

In accordance with 10 CFR 50.91, a copy of this application and the associated attachments are being prosided to the designated New York State official.
