Gentlemen:

In accordance with the provisions of 10.CFR 2.201, Notice of Violation, we are submitting our response to notice transmitted by your letter dated April 1, 1993.

This refers to the inspection conducted by Messrs. Cook and Tappert of i

your office from January'24, 1993 to March 6, 1993, at the James A.

FitzPatrick Nuclear-Power Plant.

Notice of violation Technical Specification 6.8.A states, in part, that written procedures shall be implement'ed that meet cr exceed the requirements of Section 5 " Facility Administrative Policies and Procedures" of ANSI 18.7 - 1972.

ANSI 18.7 - 1972, Section 5.3.4.2 states, in part, that procedures shall be provided to guide operations during and following a controlled shutdown or reactor trip.

AOP-1, Reactor Scram Procedure, Section C.1, Immediate Operator Actions, states, in part, place reactor mode switch in shutdown.

ODSO-2, Operating Principles and Philosophy, Section 7.3.4 requires, in part, that after immediate actions are performed, the actions are verified to be correct and complete per the appropriate procedure.

AOP-1, Reactor Scram Procedure, Section C.2.3, ARI/RPS Reset, directs, in part, that'the reactor mode switch be verified in shutdown prior to resetting the scram.

Contrary to the above, on February 25, 1993,-AOP-1, Reactor Scram, was not properly implemented, in that, the mode switch was not verified in shutdown prior to resetting the scram. -The mode switch was found-in an intermediate l

position after resetting the scram.

Response to Notice of Violation The' Power Authority agrees with this finding, and acknowledges that operating procedure AOP-1, Reactor Scram Procedure, Section.C.2.3.b.1 requires the operator to

" verify Rx mode switch is in shutdown", and that this step was not properly performed by the operator.

The fundamental.

cause of this violation was personnel error.

The scram occurred at 0140 hours0.00162 days <br />0.0389 hours <br />2.314815e-4 weeks <br />5.327e-5 months <br /> on February 25, 1993 (LER-93-004).

The immediate corrective *: tion, which occurred at 0153 hours0.00177 days <br />0.0425 hours <br />2.529762e-4 weeks <br />5.82165e-5 months <br />, was to place the mode switch in shutdown and reset the scram.

Permanent corrective action includes adding a step to the Subsequent Operator Action section of AOP-1 that will provide the operators.with a method, other than visual observations of the switch handle, to verify the reactor mode switch is in the shutdown position.

This step will be to verify that annunciator, " mode switch in shutdown trip bypass" has alarmed.

This annunciator will only' alarm if the mode switch is in shutdown and a short time delay has elapsed.

The NRC letter which transmf.tted Inspection Report No.

50-333[93-04 requested an evaluation of the post trip review process to identify measures which would strengthen the process.

A review of this process has been completed, and a j

number of changes identified.

The single largest change is the formation of the Post Transient Review Group-(PTRG).

This group will consist of three members.

One member from Operations (an SRO independent'of the transient being analyzed), one member from Technical Services, and one member from the Operations Review Group.

Procedure AP-03.01, Post Trip Evaluation will be revised to outline the responsibilities and provide guidance for the Post Transient Review Group.
