NOTICE OF VIOLATION

(NRC REGION I INSPECTION REPORT NO. 50-333/93-04)

This refers to the inspection conducted by Messrs. W. Cook and J. Tappert of this office

from January 24,1993 to March 6,1993. The inspection included a review of activities

l

authorized for your James A. FitzPatrick facility. At the conclusion of the inspection, the

findings were discussed with you and members of your staff.

Areas examined during the inspection are identified in the report. Within these areas, the

j

inspection consisted of observation of activities, interviews with personnel, and document

reviews. The purpose of the inspection was to determine whether activities authorized by the

l

license were conducted safely and in accordance with NRC requirements.

Based on the results of this inspection, certain of your activities appeared to be in violation

of NRC requirements, as specified in the enclosed Notice of Violation (Notice). During this

i

inspection period, we reviewed the actions and circumstances surrounding the operator

initiated scram of February 25,1993. While operator performance was generally acceptable,

the reactor mode switch was found out of the shutdown position after two procedurally

required verifications failed to identify it. We also noted that your post-trip review did not

identify this procedural noncompliance.

proposed corrective actions and the results of future inspections, the NRC will determine

whether further NRC enforcement action is necessary to ensure compliance with NRC

regulatory requirements.
