Dear Sir:
This letter is to inform the NRC of a commitment change made in accordance with the guidance contained in Nuclear Energy Institute Guideline NEI 99-04, "Guidelines for Managing NRC Commitment Changes" (Reference 1) endorsed by the Commission in NRC Regulatory Issue Summary 2000-17, "Managing Regulatory Commitments Made by Power Reactor Licensees to the NRC Staff' (Reference 2).
This commitment was revised in December 2000 based on FitzPatrick commitment change request CCR-00-001. A recent review of commitment changes identified the inadvertent omission of this commitment change from the biennial update letter (JAFP-01-0123) dated May 16, 2001 (Reference 3). This omission was documented in our corrective action system. FitzPatrick staff reviewed all commitment changes made using the guidance of NEI 99-04 and determined that this was the only such commitment change, of which the NRC was not informed. to this letter provides a summary of commitment change request CCR 001.

FitzPatrick response letters (No. JPN-91-015, dated April 18, 1991 and JPN-93-015, dated March 16, 1993) to NRC Generic Letter No. 89-13, Service Water System Problems Affecting Safety-Related Equipment Commitment:
JPN-91-015 stated: "The Authority started to test for the presence of zebra mussels in the FitzPatrick intake structure and lake cooling water during the 1990 breeding season.
Mussels were detected but not in sufficient numbers to cause fouling or require counter measures. Periodic tests will resume when lake temperature rises to 40 degrees Fahrenheit."
JPN-93-015 stated: "Water column Veliger Sampling performed weekly when lake temperatures are greater than 40TF."
Revised Commitment:
Water column Veliger Sampling performed weekly when lake temperatures are greater than 50TF.
Justification for Change:
Based on the historical sampling data growth and build-up of zebra mussels is minimal at lake temperatures less than 50TF. Therefore, sampling at lower temperatures is not required. This change was reviewed and processed using the guidance of NEI-99-04 and is documented as commitment change CCR-00-001.
