NOTICE OF VIOLATION The Cleveland Electric Illuminating Docket No. 50-440-Company

As a: result of the inspection conducted on November 3 through December 21, 1987, and in.accordance with 10 CFR Part 2, Appendix C - General Statement of Policy l: and Procedure for NRC Enforcement Actions (1987), the following violation was identified:

10 CFR 50, Section 50.59 states: "The holder of a license authorizing operation of a production or utilization facility may make changes to that facility as described in the safety analysis report without prior Commission approval unless the change involves an unreviewed safety question or change to the technical specifications." Further, the licensee must maintain records including a written safety evaluation which provides the bases.for the determination that the change does not involve an unreviewed safety questio Contrary to the above, the licensee failed to perform the required safety

, evaluation for temporary modification LLJED No. 1-87-077 which changed-the i

circuitry of the Division III Diesel Generator water jacket heater as described in Section 9.5.9.2.2 of the FSAR by adding filter chokes to each electrical phase of these heater This is a Severity Level IV violation-(Supplement 1).
