SUBJECT: NRC INVESTIGATION REPORT NOS. 1-2013-023 AND 1-2014-007 AND NOTICE OF VIOLATION

Dear Mr. Ventosa:

This letter refers to two investigations by the U.S. Nuclear Regulatory Commission (NRC) Office of Investigations (OI) conducted at Entergy Nuclear Operations, Inc.'s (ENO's) Indian Point Energy Center. The investigations, which completed on February 10, 2014, and May 21 2014, involved security matters that are considered safeguards information. Therefore, details of the investigations are not included in this letter, but are described in the non-public Enclosure 1. Based on the results of the NRC OI investigations, the NRC concluded that violations of NRC requirements occurred, that have been assessed at Severity Level IV. The violations are being cited in the enclosed Notice of Violation (Notice) because the NRC identified them. The Notice is provided as Enclosure 2 of this letter. Further, a separate licensee-identified violation, associated with a finding that was determined to be of very low security significance (Green), is described in Enclosure 1. The NRC is treating this violation as a non-cited violation, consistent with section 2.3.2 of the Enforcement Policy. The NRC notes that ENO has taken immediate corrective actions to address any security-related vulnerability.

You are required to respond to this letter and should follow the instructions specified in the Notice when preparing your response. If you have additional information that you believe the NRC should consider, you may provide it in your response to the Notice. The NRC will use your response, in part, to determine whether further enforcement action is necessary to ensure compliance with regulatory requirements.

Enclosures contain Safeguards Information. When separated from its enclosures, this document is DECONTROLLED In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter will be made available electronically for public inspection in the NRC Public Document Room located at NRC Headquarters in Rockville, MD, and from the Publicly-Available Records (PARS)

component of NRC's document system, ADAMS. ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room). However, because of the security-related concerns contained in the enclosures, and in accordance with 10 CFR 73.22, copies of this letter's enclosures will not be available for public inspection. In addition, the NRC is waiving the affidavit requirements for your response. This practice will ensure that your response will not be made available electronically for public inspection in the NRC Public Document Room or from ADAMS. If Safeguards information is necessary to provide an acceptable response, please provide the level of protection described in 10 CFR 73.21. Otherwise, make your entire response, "Security-Related Information - Withhold Under 10 CFR 2.390," and follow the instructions for withholding in 10 CFR 2.391(b)(1).

This enforcement action will be administratively tracked under Inspection Report Nos.
