SAN ONFORE NUCLEAR GENERATING STATION - NRC SECURITY INSPECTION REPORTS 05000206/2016402 AND 07200041/2016401 AND EXERCISE OF ENFORCEMENT DISCRETION
Dear Mr. Palmisano:
On March 24, 2016, the U.S. Nuclear Regulatory Commission (NRC) completed a security inspection at your San Onofre Nuclear Generating Station, Unit 1 and Independent Spent Fuel Storage Facility. The NRC inspector discussed the results of this inspection with you and other members of your staff at the inspection final exit meeting on March 24, 2016. The inspection results are documented in the enclosure to this inspection report.
The inspection examined activities associated with your license as they relate to security and compliance with the Commissions rules and regulations. The inspector reviewed selected procedures, records and interviewed personnel.
Based on the information developed during the inspection, the NRC determined that violations of NRC requirements in Title 10 Code of Federal Regulations (CFR) Part 37, with respect to the large component containing category 1 or category 2 quantities of radioactive material, occurred.
In accordance with the Enforcement Policy, these violations would normally be categorized at Severity Level IV. However, in accordance with NRC Enforcement Guidance Memorandum (EGM) 14-001, Interim Guidance for Dispositioning 10 CFR Part 37 Inspection Findings with Respect to Large Components and Robust Structures Containing Category 1 or Category 2 Quantities of Material at Power Reactor Facilities Licensed under 10 CFR Parts 50 and 52, issued March 13, 2014, the NRC is exercising enforcement discretion and not pursuing any enforcement action for these violations. In accordance with 10 CFR 2.390, Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRCs Public Document Room or from the Publicly Available Records (PARS) component of the NRC's Agencywide Documents Access and Management System (ADAMS). ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room).
However, the material enclosed herewith contains Security-Related Information in accordance with 10 CFR 2.390(d)(1) and its disclosure to unauthorized individuals could present a security vulnerability. Therefore, the material in the enclosure will not be made available electronically for public inspection in the NRC Public Document Room or from the PARS component of NRC's ADAMS. If you choose to provide a response and Security-Related Information is necessary to provide an acceptable response, please mark your entire response "Security-Related Information
- Withhold from Public Disclosure under 10 CFR 2.390" in accordance with 10 CFR 2.390(d)(1)
and follow the instructions for withholding in 10 CFR 2.390(b)(1). In accordance with 10 CFR 2.390(b)(1)(ii), the NRC is waiving the affidavit requirements for your response.
