Thank you for your letter of April 12, 1983, in response to our letter of March 16, 1983.
Your response included a request for a clarification of the portion of the violation regarding the operating status of the reactor safety channels (power level). We acknowledged that the safety channels were operating during the period of December 4-9, 1982, and that a reactor scram would have occurred if required.
The fact that the reactor would have scrammed at a higher power level is important in that it would have mitigated the consequences of an actual accident.
Although the system was operating it was not considered to be capable of performing its intended function of scramming the reactor at or below the Technical Specification set point. This inability of the system to trip the reactor at the required power level is the basis for the violation.
