i REPORT OF INTERVIEW WITH MORRIS A. EARL EARL was interviewed on July 6, 1990, in the Region II office at the U.S.

1 Nuclear Regulatory Commission (NRC),101 Marietta Street, Atlanta, Georgia.

EARL had previously contacted the Office of Investigations (01) at which time he identified himself as the president and co-owner of Spectronics, Inc. EARL i said he had 1 Earned from his co-owner, Eugene (Pete) TOLBERT, in Mobile, '

Alabama, that the NRC had interviewed him. EARL was invited to the Region II office for an interview to which he voluntarily complied. Upon being advised [

of the interviewer's official identity and purpose of the interview, EARL l l

provided the following information.

said he and TOLBERT purchased Spectronics in 1988 as co-owners with TOLBERT taking the title of vice president. As president, EARL said he handles the i management, purchasing, and product development aspects and that TOLBERT l 1

controls the sales, personnel management, and local operations.

EARL said he did not personally know William STOKLEY nor had he ever talked with him but was under the impression that Stokley Enterprises was an authorized distributor for Potter and Brumfield (P&B) electric products. EARL said he had never discussed Bill ST0KLEY's business practices or products with TOLBERT and had never inspected ST0KLEY's place of business in Virginia. EARL was asked about the meaning of the term " conversion" as it related to electrical relays Spectronics had purchased from Stokley Electronics. EARL said he was unfamiliar with the term even after inspecting purchase orders and invoices referring to conversions of various models of P&B electrical relays.

EARL appeared confused by the issue of conversions and said he was not that familiar with relay applications nor was he aware that relays could be converted. He added that he primarily handles industrial and commercial products and TOLBERT handles military contacts. EARL said he was also unfamiliar with the practice of Spectronics sending Stokley a new relay in exchange for a converted relay. He again appeared confused and questioned the interviewer why his company would want to do such a thing. He was advised that TOLBERT previously described such a practice to 01 investigators as a way of explaining why Spectronics was shippirg relays to Stokiey.

He EARL said his company does not solicit business from the nuclear industry.

said he visited a plant involved in manufacturing electric panel boards for the nuclear industry in order to investigate the possibility of marketing Spectronics' line of products. He said he discounted the idea when he learned of the many special regulations involved and the limited market.

EARL said while reviewing sales records in the past, he has noticed some of the P&B relays had three digit model numbers while others had four digits. He said TOLBERT told him the relays had different model numbers because they had different applications. EARL said after they were notified by Carolina Power g I

s had inspected the Stokley relays. EARL said he was told by TOLBERT that he i had inspected the relays and they were no different from those received from P&B. P EARL said he would not sell reconditioned surplus products if he in fact knew the product was used. He added that he has never dealt with any companies that sell refurbished electrical products. He said he has no financial interest in Stokley Enterprises or any other company. He said he has never been investiga,ted for any of nis dealings with the U.S. military.
