1. I am an employee of the United States Nuclear Regulatory Commission (NRC). My place of employnent is the NRC. Region II offices, Atlanta, Georgia. I am the Director,- Enforcement and Investigation Coordination Staff. I have held this position as Acting Director and Director since April 16, 1983. I am responsible 'for

Ueneral Electric Company, Fuel Fabrication' Facility, located in Wilmington, NC.

2. The NRC enforcement authority derives primarily from sections 161, 186, and 234 of the Atomic Energy Act of 1954, as amended. 10 CFR Part 2, Appendix C, as revised, 49 Fed. Reg. 8583 (March 8, 1984), sets out the NRC enforcement policy. Acopy) is attached. This policy provides guidelines for the application of the NRC's enforcement authority to particular factual situations. In this context the policy -contains several supplements which provide examples of violations at various severity ,

levels for particular types of NRC licensees and/or.

licensee activities. Violations are categorized into five severity levels: Severity Levels I and II involve very significant violations; Severity Level III violations are significant; Severity level IV c

violations are significant if left uncorrected; and

. Severity Level V violations are of minor concern.;

each allegation, the chart identifies Region II's conclusions on whether a violation of NRC-I requirements was found and if so, the Severity:

. 3 inclusive, but only provide guidance to the NRC l staff in assigning severity levels. Moreover, the enforcement policy specifically provides that the exanples in the supplements are just that and that they are neither controlling nor exhaustive. The chart also identifies why other allegations, even if substantiated, were not considered by Region II to constitute violations of NRC requirements.

3. Some of the inspection reports related to Ms.

English's concerns have not yet been issued, and the NRC continues to receive information from Ms.

English which must be evaluated. In several instances where inspection reports have not yet been issued, the inspector has made a preliminary finding that a vio1'ation has been identified which has been orally communicated to the licensee in an exit interview at the conclusion of the inspection.

However, Region II has not yet completed its review

, levels for such violations. This circumstance is t

, [ reflected in the attached chart. Results of this review will not be made publicly available until the Region has issued its inspection report and Notice of Violation, if appropriate.

4. NRC Region'II has issued the attached inspection

. 4 reports and notices of violation. Some of these actions are being contested by both GE and Vera English. Normally, these matters would be resolved by the Region unless the severity levels of the violations are categorized at Severity Level III or above. Matters involving Severity Level III or higher are reviewed by the headquarters Office of Inspection and Enforcement (IE) in Washington, D.C.

5. NRC has received a 10 CFR 2.206 request with two supplements fron Mozart T. Ratner, Esq. on behalf of Ms. English asking the Director, Office of Inspection and Enforcement to review the inspection findings, violations, ,and severity levels assigned by Region II to certain violations related to the allegations raised by Ns. English. Under C
