SUBJECT:

Drug and Alcohol Testing Errors Vermont Yankee Nuclear Power Station Docket No. 50-271 License No. DPR-28

Dear Sir or Madam:

In accordance with the reporting requirements of 10 CFR 26.719(c)(1), Entergy Nuclear Vermont Yankee, LLC (VY) is submitting this report to discuss several blind performance drug testing errors.

On May 18, 2009, VY was provided test results that were inconsistent with the expected results. In each case, the Health and Human Services (HHS) confirmatory laboratory lab returned an incorrect result. Upon identification of the errors, VY contacted the vendor who supplied the blind performance samples, the HHS confirmatory laboratory who tested the samples, and the VY medical review officer to notify them of the testing errors and to initiate an investigation into the circumstances surrounding the errors. VY investigation was completed on June 16, 2009 and the cause was determined to be associated with the vendor who prepared the specimens. The VY program continues to meet the requirements of 10 CFR 26, with no onsite implementation errors. VY has discontinued purchases from this vendor and will purchase all future blind performance specimens from another qualified vendor.

There are no new regulatory commitments being made in this letter.

Should you have any questions or-require additional information concerning this submittal, please contact Mr. David J. Mannai at (802) 451-3304.

Sincerely,

[MJC/RAM]
