Dear Sir:
As requested by the above referenced letter, Florida Power Corporation (FPC), doing business as Progress Energy Florida, Inc. (PEF), is providing a response to the Freedom of Information Act Case FOIA-2010-0010. The NRC requested that appropriate Crystal River Unit 3 (CR-3) personnel review the records, provided in the referenced letter as being responsive to a FOIA request and determine what portions of the records, if any, should be withheld from public disclosure because it contains confidential (proprietary) information.
For information deemed appropriate, it was requested that information be clearly bracketed [ ] and returned to the NRC, along with a letter fully answering specific questions in sufficient detail to permit the NRC to make a determination on the CR-3 claim.
The purpose of this letter is to provide notification that appropriate CR-3 personnel have reviewed the records attached to the subject letter and have determined that none of the records fall within Exemption (4) of the FOIA (5 U.S.C. § 552(b)(4)) and 10 CFR § 9.17(a)(4).
This letter contains no new regulatory commitments.
