Office of Nuclear Reactor Regulation (NRR)

Items of Interest Week Ending JUNE 18, 2021 NRC Launched the Public Operating Reactor Analytics Webpage On June 14, 2021, the NRC staff released the first version of the Operating Reactor Analytics Web page to the public: http://www.nrc.gov/reactors/operating/oversight/analytics.html. The Operating Reactor Analytics Web page provides a compilation of historical and current Reactor Oversight Process information in a user-friendly format to explore or download for analysis.

NRC Participated in American Society of Mechanical Engineers Operation and Maintenance of Nuclear Power Plants Committee Meeting During the week of June 14, 2021, NRC staff participated in virtual committee meetings of the American Society of Mechanical Engineers (ASME) Operation and Maintenance of Nuclear Power Plants (OM Code). This meeting is conducted twice a year to discuss proposed improvements to the ASME OM Code for inservice testing (IST) programs for pumps, valves, and dynamic restraints at nuclear power plants. The NRC regulations require nuclear power plant licensees to implement the IST provisions of the ASME OM Code as incorporated by reference in Title 10 of the Code of Federal Regulation (10 CFR) Section 50.55a, Codes and standards with specified conditions. The NRC periodically updates 10 CFR 50.55a to incorporate by reference new editions of the ASME OM Code with any appropriate conditions.

NRC Hosted Meeting to Discuss Requirements Regarding Valve Position Indication On June 14, 2021, the NRC staff conducted a public meeting to discuss the requirements for valve position indication in the ASME OM Code as supplemented by 10 CFR 50.55a(b)(3)(xi),

OM condition: Valve Position Indication (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21162A301). The NRC staff also discussed the regulatory process for alternative requests for the valve position indication requirements in accordance with 10 CFR 50.55a(z). During the meeting, the Nuclear Energy Institute made a presentation as part of the question and answer session. The NRC staff encouraged nuclear power plant licensees considering the submittal of an alternative request for valve position indication to contact their NRC Project Manager to schedule a pre-submittal meeting.

NRC Hosted Meeting to Discuss Options for Applying Risk-Insights to the Medical Examination Requirements On June 15, 2021, the NRC staff held a public meeting with the National Organization of Test, Research, and Training Reactors to discuss options for applying risk-insights to the medical examination requirements under 10 CFR Part 55 for the issuance of licenses to operators at non-power reactor and utilization facilities (NPUFs) (ADAMS Accession No. ML21147A491).

The meeting was held in response to a comment submitted for the Retrospective Review of Administrative Requirements initiative to appropriately align the operator medical qualifications requirements imposed on NPUFs with their inherently low risk profile.

NRC Approved Licensing Requests for Regulatory Relief Related to the COVID-19 Pandemic The NRC staff has reviewed and approved several licensing requests seeking temporary flexibilities to maintain the safe and secure operation of the U.S. nuclear fleet during the pandemic. A summary of approved licensing actions provided during this reporting period are summarized below. Office of Nuclear Material Safety and Safeguards (NMSS)

Items of Interest Week Ending JUNE 18, 2021 NRC Received Letter of Intent from the State of Indiana On June 11, 2021, Indiana Governor Eric Holcomb submitted a letter to Chairman Christopher Hanson indicating the States intent to become an Agreement State in accordance with Section 274b of the Atomic Energy Act of 1954, as amended. Under the Agreement, the NRC would discontinue, and the State of Indiana would assume, the authority to regulate the use of radioactive materials at approximately 200 academic, medical, and industrial facilities in the State. The State requested that the final agreement be completed by January 1, 2026.

NRC Participated in the 2021 American Nuclear Society Virtual Meeting On June 15, 2021, the NRC staff participated in the 2021 American Nuclear Society Virtual Annual Meeting panel Closing the Fuel Cycle with Small Modular Reprocessing Facilities. The NRC staff discussed the status of regulatory framework activities at the NRC, including the recent issuance of SECY-21-0026, Discontinuation of Rulemaking-Spent Fuel Reprocessing, recommending discontinuation of the reprocessing rulemaking. Other panelists from the Oak Ridge National Laboratory, Argonne National Laboratory, Idaho National Laboratory, and Orano USA discussed the feasibility and potential drawbacks of using small modular recycling facilities to close the fuel cycle.

Revision of Fee Schedules; Fee Recovery for Fiscal Year 2021: Final Rule; 10 CFR Parts 15, 170 and 171 (NRC-2018-0292; RIN 3150-AK24)

On June 16, 2021, the NRC published a notice in the Federal Register (86 FR 32146) amending the licensing, inspection, special project, and annual fees charged to its applicants and licensees. These amendments are necessary to implement the Nuclear Energy Innovation and Modernization Act (NEIMA), which, starting in Fiscal Year 2021, requires the NRC to recover, to the maximum extent practicable, approximately 100 percent of its annual budget less certain amounts excluded from this fee-recovery requirement. In addition, the NRC is making improvements associated with fee invoicing to implement provisions in NEIMA. This final rule is effective on August 16, 2021.

Items of Interest Week Ending JUNE 18, 2021 Decision Issued on Differing Professional Opinion On May 13, 2021, the Director, Office of Nuclear Reactor Regulation (NRR) issued a decision on a Differing Professional Opinion (DPO) submitted on July 21, 2020, titled TSTF [Technical Specification Task Force]-505 RITSTF [Risk-Informed Technical Specification Task Force]

Initiative 4b, Revision 2, and NEI 06-09-A, Revision 0. The DPO submittal raised concerns that select electrical power system-related provisions in TSTF-505, Revision 2, Provide Risk-Informed Extended Completion Times - RITSTF Initiative 4b (Agencywide Documents Access and Management System (ADAMS) Accession No. ML18183A493), could result in a nuclear power plant not meeting regulatory requirements or being in an unanalyzed condition. On February 19, 2021, an Ad Hoc Panel (Panel) provided the results of its independent review of the DPO to the Director of NRR. The Director of NRR agreed with the Panel's conclusion and recommendation to emphasize that independent technical review of plant-specific electrical transmission and distribution system configurations is essential to ensuring the appropriate eligibility of technical specification limiting condition of operation completion times for a risk-informed completion time under TSTF-505. The Panels second recommendation regarding the handling of differing views submittals was referred to the Office of Enforcement. The DPO Case File can be found at ADAMS Accession No. ML21155A062.
