This is to inform you that the U.S. Nuclear Regulatory Commission (NRC) has approved an Agreement with the State of Wyoming under Section 274 of the Atomic Energy Act of 1954, as amended (the Act). The Commission has determined that the Wyoming program for the regulation of materials covered by the Agreement is compatible with the Commissions program and is adequate to protect public health and safety. Under this Agreement, Wyoming has assumed regulatory authority over the management and disposal of byproduct material as defined in Section 11e.(2) of the Act and a subcategory of source material or ores involved in extraction or concentration of uranium or thorium milling in the State. The Agreement became effective on September 30, 2018.
The NRC staff will conduct periodic reviews of the Wyoming program to ensure that the terms of the Agreement continue to be met.
