SUBJECT:

FOLLOW-UP ON SITES WITH 3M FAILED DEVICES AND ESTABLISHMENT OF NEW LIST OF LEAKERS With regards to the list of sites with failed devices, totaling 63, dated February 26, 1988, there is not a need to continue up-dating this list.

i Headquarters will continue to monitor the list to assure that all of the sites are decontaminated. Regions are quested to report to Headquarters each Thursday by close of business, those sites within their Region which have been decontami.14ted and released for unrestricted use, also indicate the office i.e., ,

(Region or Agreement State) releasing the site.

There is a need to establish a new master list of leaking devices. The Orders to 3M and General Licensees dated February 18, 1988, suspended the authority to transfer or use any Po-210 static elimination devices to persons generally licensed except as may be specifically authorized in writing by the NRC. The Order further directed 3M to instruct users of the devices to return them to 3M as soon as feasible but within 90 days of the date of the M.s and to promptly test the devices for detectable leakage. The following procedures will be followed by 3M to comply with the Order:

a. As results are available 3M will fax to each Region a list of facilities with leakers within their respective regions. (See attached 3M Form NSE-104-1  ;

for report format.) j

b. 3M will conduct surveys by priorities, priority 1 will be leakers showing greater than 5 nano curies that were used in processing consumer products; priority 2 will be leakers with greater than 5 nano curies used in industrial processes, and priority 3 will be leakers with less than 5 nano curies for all types of facilities. Regions and Agreement States are req.:ested to use the same priority system in conducting random surveys to confirm 3M's findings. ,

Headquarters will maintain a new master list of leakers and this list will be ,'

updated on a monthly basis. The first list will be published on April 1, 1 1988 and the first day of month thereafter. f

c. 3M will provide to Region III a master list of all leakers returned to 3M on a monthly basis, with the first list being provided on March 21, 1988.

As a further requirement of the Order, 3M will also provide to Region !!! a list of general licensees who failed to return their static eliminators. Region III will provide this list to the respective Regier.s for followup, f

SUBJECT:

SPECIAL INSPECTION OF NRD STATIC ELIMINATORS We believe that it is necessary for surveys to be conducted of a sample of NRD static eliminators to ascertain whether a similar problem exists with these devices as was identified with the 3M devices. Surveys could be conducted

, during routine inspections at other facilities in the same geographic area to conserve resources. The procedures developed to inspect the 3M devices would also be applicable in this case.

Additionally, SLITP has requested that the Agreement States conduct similar inspections of NRD devices. The Agreement States have identified general licensees in their state by using the quarterly material transfer reports received from NRD. We suggest that you coordinate your inspections with the Regional Agreement State Officer to make the best use of resources both within NRC and the Agreement States.

Enclosed are copies of material transfer reports received by hRC covering about a one year time period. These reports identify general licensees in i your regional area that have been shipped static eliminators manufactured by

' hRD Inc., a New York State licensee. Due to limited inspection resources, a l

small sample should be selected by the Regions to be surveyed.

l The transfer reports have twc identifier codes on the top right side of each page. The first is a number th.! indicates the quarter in which the devices

, were distributed. For example, the code 2/87 or 2 QTR 87 denotes the second

, quarter of 1987. The second is a set if initials that indicates the

distributor of the devices. This is detated by NRD (NRD Inc., license nurrber 1429-1811) and HPI (Herbert Products Inc., license number 1430-1950). HPI is 4 also a New York State licensee and acts as 6 sales agent for NRD.

' Please also find enclosed a copy of a report concerning a site visit to NRD by

hRC's State Agreecents program and the State of New York. The enclosures to this document contain useful descriptive information about the hRD static eliminators.

X. Abraham J. McGrath Numerous telephone inquiries have been received by NMSS and the NRC Regional Offices / rom general licensees concerning the Order To General 3/4/88 Licensees dated February 18, 1988. These inquiries have covered a range of subjects:

Requests for clarification of the requirements in the Order and the basis for the Order Requests for exceptions from the requirements of the Order on the basis of workplace safety Requests for exceptions from the requirements of the Order on the basis of workplace safety for licensees involved in operations connected with food, beverages, pharmaceuticals, medical devices, or cosmetics. These licensees are not authorized exceptions by the terms of the Order Requests for continued use on the basis of economic hardship and/or product quality. Continued use for these reasons is not permitttd by the terms of the Order Additional guidance has been prepared for Regional Staff in addressing authorized requests for temporary continued use. This guidance concerns delays in obtaining prior written approval for temporary continued use and, for persons with workplace safety considerations in the production or packaging of food, beverages, pharmaceuticals, medical devices, or cosmetics, the granting of temporary relief if i,he approval of the Food and Drug Administration is obtained.

NRC personnel have visited NRD, a manufacturer of polonium-210 static elimination devices with a design different from that of the 3M devices. In the NRD devices, the polonium oxide is combined with gold by a powder metallurgy process and then laminated with a gold overlay.

To provide additional assurance of the integrity of the NRD devices, surveys of facilities using these devices are being scheduled. NRC and California State personnel have also visited a company in California that, under a general license in 10 CFR 31.3, used foils from both 3M and NRD in manufacturing static elimination devices. They have stopped using 3M foils.

Information has been received concerning another manufacturer of static elimination devices not previously known to the NRC. The facts concerning this manufac4.Jrer and its devices are being ascertained, preliminary evidence from Brookhaven National Laboratory, which has been examining 3M devices for the NRC, indicates racking of the epoxy in which the microspheres containing the polonium are embedded.

The list of sites with failed 3M devices is no longer being distributed, but sites on the list are being followed until those that are contaminated have been released for unrestricted use.
