SUBJECT: INSPECTION NO.150-00031/98-004 AND NOTICE OF VIOLATION

Dear Mr. Lynn: l

On September 11,1998, Mr. Steven Courtemanche of this office conducted a safety inspection l

during a telephone discussion with you of licensed activities conducted under NRC jurisdiction. I

The inspection was an examination of your licensed activities as they relate to radiation safety  !

and to compliance with the Commission's regulations and the license conditions. The

inspection was limited to interviews with personnel related to activities within the NRC's

jurisdiction. The findings of the inspection were discussed with you during the telephone

conversation on September 16,1998 at the conclusion of the inspection.

Based on the results of this inspection, it appears that your activities were not conducted in full

compliance with NRC requirements. A Notice of Violation is enclosed and categorizes the

violation by severity leval in accordance with the " General Statement of Policy and Procedure

for NRC Enforcement Actions, "(Enforcement Policy), NUREG-1600. You are required to

respond to this letter and should follow the instructions specified in the enclosed Notice when

preparing your response. In your response, you should document the specific actions taken

and any additional actions you plan to prevent recurrence. Your response may reference or

include previous docketed correspor.dence, if the correspondence adequately addresses the

required response. After reviewing your response to this Notice, including your proposed

corrective actions and the results of future inspections, the NRC will determine whether further

NRC enforcement action is necessary to ensure compliance with NRC regulatory requirements.

The violation described in the enclosed Notice of Violation concems the failure to file for j

reciprocity with the appropriate NRC Regional Office for licensed activities under NRC

' jurisdiction which was authorized by the general license in 10 CFR 150.20(a). The violation is f

classified at Seventy Level IV after careful consideration of the factors involved in this specdic (

!

instance and in accordance with the " General Statement of Policy and Procedure for NRC

Enforcement Actions," (Enforcement Policy), NUREG-1600. Specifica!!y, this violation posed a

minimal health and safety problem because of the nature of the licensed material (i.e.,10

millicuries of cadmium-109, a low-energy beta-emitter, in the form of a sealed source) and

represents an isolated rather than a programmatic weakness in your radiation safety program.

Similar violations of this type in the future may result in additional enforcement action.
