REQUEST TO AEROTEST OPERATIONS, INC. AND NUCLEAR LABYRINTH LLC TO SUPPLEMENT THE LICENSE TRANSFER APPLICATION (TAC NO. ME8811)

Dear Mr. Brisighella and Dr. Slaughter:

By letter dated May 30, 2012, (Agencywide Documents Access and Management System (ADAMS) Accession No. ML12152A233), Aerotest Operations, Inc. (Aerotest) and Nuclear

Labyrinth LLC (Nuclear Labyrinth), jointly submitted an application (Accession No. ML12180A384) requesting U.S. Nuclear Regulatory Commission (NRC) consent, pursuant to Title 10 of the Code of Federal Regulations (10 CFR) 50.80, for the indirect license transfer of the Aerotest Radiography and Research Reactor (ARRR) Facility Operating License from Aerotest to Nuclear Labyrinth. The indirect license transfer would occur as a result of the

proposed sale of Aerotest by Autoliv, ASP, Inc. to Nuclear Labyrinth.

The NRC staff is unable to complete its acceptance review of your application without obtaining the additional information delineated in the enclosure to this letter which is necessary to enable the NRC staff to determination if the application is acceptable for review.

In order to make the application complete, the NRC staff requests that Aerotest and Nuclear Labyrinth supplement the application to address the information requested in the enclosure within 10 business days from the date of this letter. The NRC staff will make a determination of whether the application as supplemented will be accepted for review pursuant to 10 CFR 2.101.

If the application is subsequently accepted for review, you will be advised of any further information needed to support the NRC staff

=s detailed technical and financial review by separate correspondence.

The information requested and associated time frame in this letter were discussed with Mike Anderson from Aerotest, David Slaughter from Nuclear Labyrinth, and Jay Silberg and Kimberly Harshaw from Pillsbury Winthrop Shaw Pittman LLP during a conference call on June 21, 2012. It should be noted that in the transmittal letter and Attachment 1 of your application, you requested approval of the application by September 30, 2012. In our conference call of June 21, 2012, we communicated to you that complex regulatory license actions could take a year or more to complete. However, we would exercise any available efficiencies.
