SUMMARY

OF THE MARCH 2, 2023, HYBRID OBSERVATION PUBLIC MEETING WITH NUSCALE POWER ON ITS EMERGENCY ACTIONS LEVEL SCHEME METHODOLOGY The U.S. Nuclear Regulatory Commission (NRC) staff held a hybrid observation public meeting with NuScale Power, LLC (NuScale) on March 2, 2023. NuScales stated that the purpose for this meeting was to present its emergency action level (EAL) methodology with an assumed site boundary plume exposure emergency planning zone (EPZ), for future NuScale US460 licensees, such as Carbon Free Power Project (CFPP), to meet the applicable regulatory requirements regarding emergency plans.

The public meeting notice was posted on the NRC public website on January 31, 2023, and can be accessed on Agencywide Documents Access and Management System (ADAMS) Accession No. ML23031A117. NuScales non-proprietary presentation slides for this public meeting can be found under ML23051A036.

During the open portion of the presentation, NuScale stated that although the current guidance documents on developing EAL methodologies such as Nuclear Energy Institute (NEI) 99-01, Methodology for Development of Emergency Action Levels, or NEI 07-01, Methodology for Development of Emergency Action Levels Advanced Passive Light Water Reactors, are not applicable to small modular reactors, NuScale used these guidance documents to the extent possible in developing its methodology. NuScale further stated that its plans to submit a licensing topical report to the NRC to obtain NRC approval of the methodology.

During the closed portion of the meeting, NuScale presented additional details regarding considerations it took for developing the methodology, as well as the guidance documents it used to address those considerations. The staff discussed the limitations on using NEI 99-01 or NEI 07-01 as a model for a NuScale-specific EAL scheme.

The NRC staff also stated that there could be several successful formatting and submittal options that NuScale could consider when submitting an EAL scheme methodology topical report for NRC review and approval. The staff inquired if NuScale had considered using the process that NEI had used to submit its NEI 99-01 and NEI 07-01 methodologies guidance documents for NRC endorsements. The NRC staff also reminded NuScale that the staff may not be able to complete a timely review of a topical report that referenced SECY-22-0001, Final Rule: Emergency Preparedness for Small Modular Reactors and Other New Technologies, because it has not yet been approved by the Commission. NuScale commented that the topical report is not reliant on the proposed rule, however, when the rule is issued the methodology in topical report will meet the intent of the rule.

At the conclusion of the meeting, the NRC and NuScale staff agreed to coordinate on a submittal format and to schedule a presubmittal readiness assessment, or a page-turn, of the topical report as these activities would give the staff important and early insights to the topical report, before it is formally submitted. It was also stated that additional benefits of a readiness assessment, or a page-turn, could be that it would allow the staff to observe the level of detail that NuScale plans to include in the topical report to identify any significant gaps in the required information.
