LASER ISOTOPE SEPARATION TECHNOLOGIES, INC. FACILITY SECURITY CLEARANCE APPROVAL LETTER
Dear James Everly:
In a letter dated February 18, 2025 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML25050A605), Laser Isotope Separation Technologies, Inc. (LIST) requested the issuance of a U.S. Nuclear Regulatory Commission (NRC) non-possessing facility security clearance (FCL) for access to classified information at NRC approved locations.
The NRC has reviewed the Certificate Pertaining to Foreign Interests for LIST, dated January 7, 2025, and other supporting documentation. A favorable Foreign Ownership, Control, or Influence (FOCI) review rendered on March 12, 2025, determined that the degree and extent of FOCI over LIST does not pose an undue risk to the national security. Therefore, no restrictions will be placed on LIST for reasons of FOCI.
Based on the favorable FOCI determination and Standard Practice Procedures Plan for your company, LIST is hereby granted an NRC FCL (N4211) at the Secret-Restricted Data level under Title 10 of the Code of Federal Regulations (10 CFR), Part 95. The FCL determination is contingent and will be considered active upon issuance of key management personnel (KMP) security clearances. This FCL authorizes LIST access to classified matter only at NRC headquarters facility. Should access be required at another location, LIST must notify the NRC prior to access being granted.
10 CFR 95.18 requires KMP to be cleared commensurate with the FCL. A review of NRC Form 405F, Owners, Officers, Directors, and Executive Personnel submitted by LIST identified James Everly, Christo Liebenberg, Rama Rhule, and Jian Yu as KMP for your organization that are required to be processed for an NRC Q level access authorization. Please contact Ms.
Linda Watson of the NRCs Personnel Security Branch at Linda.Watson@nrc.gov or 240-406-7450 to begin the process. An exclusion resolution executed on March 6, 2025, excludes all KMP that do not possess the required access authorization. The NRC understands this resolution remain in effect.
